good day,regular employee po aq at nagtratrabaho po ako as sales asst. and imported cigarettes hawak po,floating status na po kami mula nung oct.28 2010 at hindi na po kami sumasahod.sa kadahilanang naubos po yung stock,dahil sa renewal nila ng contract sa mall,na needed para sa purchase order sa supplier.after 2 months nabalitaan na lang namin na ibang kumpanya na ang may hawak ng cigarettes na hawak ng kumpanya namin.nagsubmit po ng DOLE ng temporary closure ang kumpanya nung nov.25 2010.na valid up to 6 months.
ask q lang po,stop din po ba ang pasahod sa mga empleyado,kahit hindi pa permanently close ang kumpanya,at ngayon ay iteterminate na nila ang employment dahil sa cessation of business nila dated jan.19 2011,at seperation pay lang po ang ibibigay nila,at idededuct pa po yung mga existing loans namin.
wala po bang chances na makuha o maisama sa ibibigay o babayaran samin yung backwages nung floating kami.at pagkaka-alam ko po ay may bayad pa din po kami hanngang feb.19,2011.
may hearing po kami ngayon ma-gragrant kaya po ba na bayaran kami.tnx po

The generally accepted rule with regard to salaries is that you get paid for the days worked, and not for those that were unworked.

Hindi naman makatarungan na bayaran kayo ng mga araw na hindi naman pinakinabangan ng kumpanya ang serbisyo nyo.

leighxer, from what you stated, the company did a valid suspension of operations. if they are closing permanently, then they will have to give you 30 day notice and separation pay. it is valid that they deduct the loans.

am ganun po ba,hindi po ba applicable yng Presidential Decree no.442 Article 286.
kasi sa po sa last company po namin ay binayaran kami kahit na walang stocks ng 2 buwan mahigit.

286 is applicable, but that is if the company decides to resume operations. in your case, it decided to close

hoping to get a reply..


working po ako sa call center for almost 2years. ung account po namin is tinanggal ng company dahil hindi nagkasundo s bayaran. nong sept. 30 po un. pinag leave po kme ng 1 week using our VL/SL kase dw po no work no pay while waiting for new account. nagkaron po kame ng account. unfortunately, kasama po ako don sa mga hindi nakapasa. endorsed po ulit kame sa bagong account at don po kame nakapasa. ang kaso po ang training namin Nov. 12 pa. hindi po kame pinpapasok at pinapagamit po ulit samin ung VL/SL na natitira namin. kung maubos po un no work no pay n po. kase dw po floating status kame at hindi n daw nila ksalanan bkit hndi kame nakapasa sa unang acct.

pag floating status po b, no work no pay? tsaka more than a month na po kame folating since nov. 12 pa kame babalik, dpat po db may redundancy pay n kme?
