a property with anotation on Sec. 4 Rule 74 of the Rules of Court was purchased before the lapse of the 2 years prohibitive period. the TCT however is in the name of the buyer/new owner already. btw, i am a 3rd party who will lend money to the person who bought the property w/ the sec 4 anotation. i was informed that an heir's bond should be required. who will ask for the heir's bond? me or the new owner of the property? who will benefit this? and how is this done? is there a fixed amount? should this be anotated also on the TCT? thanks!!

4 Heir's Bond - Who should pay? on Thu Jul 31, 2014 12:12 pm

Arresto Menor
This is with regards to Heir's Bond.
I have a housing loan application from the bank.
They are requiring a heir's bond since there is an annotation on Section 4, Rule 74 of the Rules of Court was placed on the title.
1. Who should pay for the heir's bond? the developer (Seller) or the Buyer (me)?
2. Who should shoulder the payment for the cancellation of Section 4, Rule 74 of the Rules of Court after 2 years? the developer (Seller) or the Buyer (me)?

Thanks a lot!
