hi!
gusto ko lang po sanang maliwanagan about property inheritance.
automatic po ba na mapupunta sa mga anak ang isang conjugal property in case of natural death of both parents, or may proseso (at mga fees) pa na gagawin or pagdadaanan ng mga children para makuha nila ang part ng inheritance nila.

6 po kaming magkakapatid, wala na po kasi ang mother namin at ang bunso namin,, ngayon ung living father namin, pinapaasikaso sa akin na pagawa daw ako ng SPA para sa conjugal property nla na isang lot sa cebu at etong bahay nila. hindi ko po maintindihan why ako pinapagawa ng SPA and for what purpose ang SPA for this case? Sabi po ng father ko kasi pag di nia napirmahan ang SPA while he lives, mapupunta daw po sa gov't ang said properties, at hindi raw po sa aming mga anak. Tama po ba ito? Ano po ba ung sinasabi ng law about property inheritance, na automatic mapupunta sa mga anak ang mana in case of death of both parents? Sana po masagot at soonest possible time ang aking katanungan. (My Tagalog is bad so I understood only some. Perhaps this can assist you some anyway Smile

IF the property is conjugal (=owned by both parents)
when one of them die
/the alive first get his/her half.
/IF there is a will, then can max 1/4 of the total ASSETS be moved different than the "automatic" by the will.
/Then the alive spouse and the children* split the rest equal

=The still alive spouse get some more than half of the total assets ALLWAYS when it's conjugal.

*Illegit children, if there are any, get HALF as much as legit children when spliting the rest.

Good day po..Nakamana po ng lupa ang tatay ko..Ng mamatay po ang nanay ko ay nag karon sya ng kabit .lahat ng pera nya ay nauubos hanggang gusto na nya ibenta pati ang lupang namana nya .Ang tanong ko po ay may karapatan po ba kami na 4 na anak na tutulan ang pag benta ng lupang mana nya.Ang sabi po nya ay walang karapatan kming tumutol dahil mana nya yun. At pwede po ba kung kami nlang pong mga anak ang gustong bumili ng lupa kesa mabenta sa iba pero ayaw naman ng tatay namin kami bumili.Maganda po relationship namin sa aming tatay hanggang nagalit sa min dahil po sa hindi namin pag sang ayon sa kabit nya..May chance po kaya na idulog sa korte na bago ibang tao..ay kaming mga anak ang bumili ng kanyang namanang lupa . My Tagalog is bad, so not sure I understood all.

I BELIEVE:
/all hiers have to sign to sell WHOLE, otherwice it can't be sold.
/but your mother can decide to SEPARATE her share and sell that, but that's a much more complicated process and cost extra to get done. That's when selling LAND, she can't separate and sell her share in a house if it's a ONE family house.

Good day po,

Tatlo po kami magkakapatid sa una na asawa ni Tatay, nagkahiwalay po sila ng Nanay ko nung maliliit pa kami kasi nagkaruon po ng ibang babae ang Tatay ko. Nagkaanak din po sila ng tatlo sa pangalawang asawa ni Tatay. Kasal po si Tatay sa una sa Mayor, yung pangalawa po hindi, nagsama lang sila. May lupa po ang Tatay ko na nakapangalan sa kanya, 7 hectares po yun. Maliliit pa po kami nuon kaya wala pa sa isip namin ang maghabol sa mga lupang naiwan nya. Namatay po si Tatay sa piling ng pangalawang asawa nya noong 1986, naiwan po ang titulo ng lupa sa kanyang pangalawang asawa. Dahil po wala namang interes ang pangalawang asawa sa lupang sinasaka nila pati mga anak nya sa una at pangalawa asawa.

Nagulat na lang po kami na nailipat na ng mga kapatid ng Tatay  ko sa pangalan nila ang 5.5 hectares ng lupang sakahin ni Tatay. Nailipat daw po ito noong 1994 samantalang 1986 namatay ang Tatay ko. Ang natitira na lang po na lupa naka name sa tatay ko ay 1.5 hectares na lang.

Ang tanong ko po:
1. Paano po kaya nailipat ng mga kapatid ni Tatay sa pangalan nila ang titulo, wala naman po pinipirmahan na deed of sale ang pangalawa at una asawa ni Tatay. May posibilidad po kaya na na forged nila pirma ni Tatay?

2. May karapatan pa po kaya kami mga anak nya sa una at pangalawang asawa sa lupa ni Tatay na naiwan at nailipat sa mga kapatid ang pangalan ng titulo? May laban po kaya kami kung ikakaso namin sa korte?

3. Ano po kaya ang unang step na gagawin namin para mabawi po ang lupain ni Tatay sa mga kapatid nya?

Malalaki na po kaming magkakapatid at nung pumunta po kami sa mga kapatid ni Tatay sinabi po sa amin na wala na lupa ang Tatay namin dun. Buhay pa po ang una at pangalawang asawa ni Tatay. Bale 6 po kami magkakapatid, tatlo po sa una at tatlo po sa pangalawa.

My Tagalog is bad, so I understood only a bit of your post.

Some things in general:
Before around 1987 weren't properties conjugal automaticly by marriage.
Properties can have been bought though paid by wife/live in partner TOGETHER with the father.
IF the father sold the properties - where are the money...?
The children born in the first LEGAL marriage have right to full share, while the other children have right to half as big share as the legit children.*

*But to add chance things can be settled without court, you can suggest the illegit children get full share.

If possible, try to settle the case WITHOUT court, because such cost much money and take very long time.
I don't know if PAO support with such cases. I guess NOT, because otherwice they wouldn't have time to anything else Smile But it don't hurt to ask them.

Good day Sir,

Actually the land was inherited from his Dad. Their father owns a vast area of farmland which he subdivided to his sons and daughters. My father got part of it (7 hectares) and he managed to secure a title for it . The problem is my father died last 1986 and the 7 hectares land that he inherited was reduced to 1.5 hectares, his brothers somehow managed to transfer its ownership to their names last 1994. How could that happen? Is there a possibility that they forged his signature? My mother neither his second wife didn't signed any deed of sale whatever. How can they have transferred it to their names? Do us children have a chance to get back the land?

Do you still have the original title? You didnt pay estate taxes for it when your father died?

Yes, the orig title is still with my father's 2nd wife. She didn't pay the necessary taxes when my father died, his brothers did.
