Good morning Atty, I hope it is okay. May question lang po kasi ako about our work. I am working as company driver for Oriental Group in Solaire. My question lang po Atty is since we are being paid minimum which 491.00, is it still deductible for the 1-hour lunch break? Last cut off lang po namin napansin na meron kaming deduction na UNDERTIME for 720 hours but when I talked to the personnel department they told me para daw yun sa 1 hr na lunch break every duty. Just to give you some details Atty para po hindi masyadong malabo sa inyo yung situaiton namin, I was hired as company driver last Dec 2016 pero wala silang pinapirmahan na probationary contract. meron lang sila pinapirmahan nitong feb or march na oo ata yun. and based sa natatandaan ko our salary was fixed something around 12,000 plus every cut off or 15 days. pero sa payroll namin ang nakalagay na sweldo is 491.00. we are working or on duty for 24 hours. let's say pasok po ako ng 7:00 am today then ang out ko is 7:00 am na rin tomorrow after that rest day ko na and then cycle na po yun. Naguguluhan po kami kasi 8 hours ang usapan naming trabaho then the rest of the hours sa isang shift namin na 12 hours ay overtime na. tama po ba na kung 12 hours ang isang shift namin ang 8 hours is the regular working hours then the rest at overtime na? Dapat po diba I start at 7am then it should end at 7 pm and dun na mag start ang another shift. Kasi nung holday po ng april 9 and 13 ay 30% lang ang binigay nila sa amin na holiday pay dahil pumasok daw po kami ng april 8 7am and nag end ang shift namin ng 12 midnight so 6 hours lang ang working hours namin nung april 9 which is from 12midnight to 7 am. di ko masyadong naintindihan yung situation mo. re payslip hindi required by law na magbigay ng payslip except sa kasambahay.
Sa OT anything exceeding 8 hours in a single day is overtime. anything below that is not overtime.

Pasensya na po kung medyo malabo yung tanong ko. Pero tama po ba pagkaintindi ko na hindi required by law ang pag issue ng payslip for company employees?
And ito po talaga ang question ko, allowed po ba sa labor law ang straight na 24 hours working schedule? kasi po gaya po sa akin ang time ko is from 7am until 7am the following day tapos rest day ko na--halimbawa po pumasok ako ngayon ng 7am tapos ang out ko 7am bukas and the rest of the day rest day ko na tapos pasok ulit same time. Ang malabo lang po kasi sa paliwanag ng hr ay yung pasok daw namin ng 7am ang cut off nun is 12 midnight kaya nung nag holiday nang april 13 hindi kami included sa double pay dahil ang oras lang daw namin is from 1am till 6am. Hindi ko lang po maintindihan kung ang ginagawa nila sa amin ay 8 hours plus overtime o straight na 24 hours at kung bakit may cut off. Naiilang naman po ako sa kanila magtanong ng magtanong dahil baka magalit. Maraming salamat po at pasensya na ulit.

Pero tama po ba pagkaintindi ko na hindi required by law ang pag issue ng payslip for company employees? - yes.

Sorry hindi ko parin maintindihan yung tanong mo. Basta if april 13 ang holiday and april 13 1am to 6am ay nagtrabaho kay merong kang 5 hours na 200% ang rate.

Thanks po sa sagot nyo, appreciate that. Pero kung sakali po, ano ang maging basehan or evidence na merong deductions sa sweldo namin like yung sa sss at iba pa. At ibig sabihin nyo po kahit below 8 hours yung binilang ng hr na working hours namin nung april 13 at 1:00 am to 7:00 am ang holiday pay nun is 200% hindi 30% lang?

At isang question na lang po. Pasensya na. diba po 8 hours ang max working hours so since nagta-trabaho kami ng 24 hours ang sobra dun sa 8 hours ay overtime na? Tama po ba? Salamat ulit.

just to clarify, anything more than 8 hours in a day is overtime. hindi mag ma matter ang cutoff. ang pag bilang nyan is kung april 13 within april 13 lang.

Kung mag tatanong ka pa pls itemize the specific time period.

example:
April 12 - 11pm to April 13 6am
April 13 - 7am to 5pm
APril 13 6pm to April 14 2am

Ganito po kasi yun, for example from april 1 to 15 ito yung sked ko:
Mar 31 - 7 am to april 1, 7 am
Apr 3 - 7 am to april 4, 7 am
Apr 5 - 7 am to april 6, 7 am
Apr 7 - 7 am to april 8, 7 am
Apr 9 - 7 am to april 10, 7 am
Apr 11 - 7 am to april 12, 7 am
Apr 13 - 7 am to april 14, 7 am
Apr 15- 7 am to april 16, 7 am

Pwede po ba ang ganitong set up? - Yes this is exactly how you count it.  Kasi April 1 12:01Am hindi na kasali sa march 31.  wag mo pansinin ang shifting.  ang bilangin mo is if merong over sa 8 hours sa isang araw.  Ang isang araw ay mag start sa 12:01 AM up to 12:00pm.  Pag iba na ang petsa hindi na kasama yun
