I'm planning to file a case against the company that terminated my employment this month. I work in a BPO industry (Call center) and I was accused of call avoidance by unplugging the headset jack. The customer's voice was heard on the recording but my voice is not. IN the BPO term we call it "Ghost call" wherein you answer an incoming call but you cannot hear any response on the line. The call was tagged as released since I'm the one ended the call since it's a ghost call. Since my voice was not heard on the recording but the customer's voice was heard, they said that the headset jack was unplugged form it's connector. One of the Quality Assurance staff clearly said that if a headset jack is unplugged from it's connector, there will be complete silence on both ends. Meaning the caller or customer and the agent will not be heard on the recording. In short, there will be dead silence on the recording. The HR supervisor who wrote the minutes didn't include the QA staff's statement on her notes and it's also not indicated on the Term paper that they served me. I'm asking the HR supervisor for a copy of the hearing voice recording but they keep on telling me that they are still waiting for the managers approval. I just want to know if I have the right to have a copy of that recording because I will use it as well as an evidence when I file a case against the company.

Nope. They have the right to refuse, as the recording is their property.

Only a court order will force them to release the information you request.

You might not want the QA's input then.

QA says -
headset unplugged = silence both ends

But customer was heard, so it is not silence on both ends

Therefore headset was NOT unplugged.
