Marami pong salamat!

Hi atty,

My husband has a child with his live in partner but he's not sure if the child was his own. The're were no acknowledgement in civil registry, hindi din po inapelyido sakanya yung bata. Kilala po yung babae na kung sino sino po yung ineescortan but unfortunately nalaman lang po ng mister ko nung hiwalay na sila. and then 2 years ago, the mother of the child filed case against him (VAWC). Marami pong nakakita noon. Until now, we are married and were having our first child nagsusustento padin po kami. Please enlighten me. God bless us all po!

akolegalwife, the legal remedy is to file a petition in court to fix the amount of support.

dindin, go to the nearest PAO office and request for assistance in filing a complaint for economic violence

Dear atty,

I have a son with my ex, he's 8yo now. The father and I separated when our son was 3yo and walang support na binibigay ang father since pinanganak ang bata. We are not on speaking terms pero minsan hinihiram niya at ng family nya ang bata para ipasyal and sometimes bibigyan ng toys like mga once or twice a year.

I sent him a letter recently and he said open sya sa support but isusulat lang daw ang gastos and saka sya magbabayad, pag walang naisulat walang babayaran. I want sana na may fixed child support amount since we're not on speaking terms and he even said na pag daw di ko kayang buhayin ang bata kukunin nalang nya. My questions are:

1. Can i demand for child support for my son? The father owns his own company so I know he has the capacity to support our child but refuses to do so
2. Can i also demand child support for the past years na hindi sya nagbigay ng kahit na anong tulong sa pagpapalaki ng bata?
3. If i migrate abroad, since illegitimate ang bata coz we're not married, do i still need his approval for that?

Maraming salamat and more power.

gabby, if the father signed the birth certificate, she can go to the nearest PAO office to ask for assistance in filing a case of RA 9262

enna, you can file a civil case and petiton for support and reimbursement and damages for the time he did not give support. You can also file a criminal case of RA 9262

Hi atty,

My husband has an illegitimate child before we got married, there were no sign and acknowledgement in the child's birth certificate though meron silang compromise agreement na stated na inaacknowledge nya yung bata at need nya mag bigay ng 5k monthly support. Now my question is; pano kung magresign sya sa current work nya and temporarily mawalan ng work, is he still obliged to render support? May case ba na pwedeng ifile sakanya? Thank you po sa sasagot. God bless!
