Good Day po. Dati po akong empleyedo ni company A. Last April 14, nagannounce po ang CEO namin kasama ang HR at accounting dept namin na hanggang April 30 2017 na lang kami sa company.
Kami po ang last batch na pinagresign ng company.
During the announcement, sinabi nila kelangan pa namin pasukan yung April 16-30. At sabi nila matanggap man kami o hindi sa company B (nakabili ng system ni company A) makakatanggap pa din kami last pay at seperation pay ganun sa mga natanggap ng unang batch nagresign at sabi po nila. Matatanggap namin yung cheke namin ng May 5 which is pay day namin dapat. Sa cheque nandun na daw po yung sahod namin April 16-30(last pay), 13th month + seperation pay. Pero last May 5, hindi nila nirelease yung mga cheque namin dahil naghihintay ng go signal ng boss. At nagkaroon "daw" po ng miscommunication sa company B na employer ko ngayon.

Ask ko lang po, labag ba sa labor code natin yung short notice ng dismissal namin? Ilang days po ba dapat ang notice ng employer kapag tinaggal nila mga employee nila? Tama po bang pagsabayin nila ng bayad yung last pay at seperation pay? 4days delay na din po yung pangako nilang ibibigay sa amin last salary at seperation pay. Mauunawaan ko po sana kung yung seperation pay lang ang madelay pero po yung last pay din which is sahod namin na pinasukan namin last april 16-30. Sobrang delay na po.

yes dapat 30 days ang notice. Usually nahuhuli ang separation pay. Kadalasan 30 to 60 days bago makuha ang last pay so i doubt na pwede mong ireklamo as "delayed" yung sahod.  Although pwede mo siguro sabihin na pinangako kasi.

yung seperation pay ba at last pay is parehas?, pagkakaintindi ko po kasi sa sepration pay, ee yung payment dapat 1year of service equivalent ng 1month salary namin? what if half month lang ng salary ang equivalent ng 1year service namin, yun lang ang babayaran nila? pwede ba ireklamo yun? tapos yung last pay is yung sahod namin dapat ng april16-30. tama po ba pagkakaintindi ko?
and gusto ko sana iconsult. pinapirma kami ng resignation ng hr namin, which is dapat di kami nagresign talaga. tinanggal kami, buong department yun ng talagng empleyedo ng company. pero yung company namin nagooperate pa din ngayon.

if ang dahilan ng termination is business closure, 1/2 month lang talaga ang bigay. last pay is yung huling salary mo, 13th month at kung may ibang monetray benefits na dapat kayong makuha.
Yes dapat hindi kayo pumirma. Pero pumirma kayo so yan ang magiging excuse nila kaya less than 30 days ang notice. technically is resignation hindi nila kayo kelangang bigyan ng separation pay
