Kaya po ganun ang title ng topic ko na ito dahil alam ko po na isang malaking kumpanya ang kakaharapin ko kung sakali pasukin ko ang prosesong ito.

Matagal na po kong nagtatrabaho bilang call center agent pero ang totoo po hindi po ako hangang ngayon pamilyar tungkol sa prosesong legal sa ganitong klaseng trabaho.

Na-TERMINATE po ako sa trabaho

* You have stated that it is clear that sharing of passwords is not allowed (which wala naman po ito kinalaman sa ikinakaso nila sa kin dahil ang issue na brought up nila sa kin ay patungkol sa customer na tumawag at humingi ng tulong para i-reconnect ang service niya dahil ang claim nung Australian agent eh posible daw kaya nawalan ng service ang customer sa phone niya ay posibleng unintentional na nangyari na pwedeng magfall sa system error o sinadya talaga at eto lang po yung nakalagay sa show cause memo na serve nila sa akin at naipaliwanag ko sa kanila)

* and that you take full accountability for anything that transpires in your log ins (na ipinaliwanag ko po sa kanila at ang malinaw na sinagot ko sa kanila "supposedly ganito nga dapat na accountable kami sa kung anung mangyari gamit ang system log ins namin pero may kasunod po iyon....na dipende pa rin yan kase dapat aware kami sa nangyari bago kami maging amenable since rampant ang system errors sa work namin" at maski sila aminado na may nangyayaring system errors)

AGENT: (kahit hindi niya personally kasalanan) Ay sir, sorry po sa nangyari, pero wag po kayo mag-alala gagawin ko makakaya ko para matulungan kayo.)

*Sa madaling salita po, iba yung kaso na inilalaban nila sa akin sa conclusion na ginawad nila ng iterminate ako.

*Nagbigay sila ng show cause memo at suspension dahil may isang customer na tumawag dahil sa pagkawala ng phone service niya; naglabas sila ng ebidensya na log ins ko ang ginamit kung bakit nangyari yon; ipinaliwanag ko sa kanila na wala akong nagawang intensyonal na pagalis ng phone service ng customer at binanggit kong talamak ang system issue at maski sila aminado sa bagay na iyon; nagdesisyon sila na iterminate ako pero ang grounds nila ay dahil sa password sharing na hindi naman punto ng ikinaso nila sa akin at hindi naman sila naglabas ng ebidensya ukol dun.

Sana po matulungan ninyo ako sa problema ko. Gusto ko rin po maiayos na ito dahil po itong nangyari na ito ay may malaking epekto sa sa akin dahil sa susunod na trabahong papasukasn ko alam ko mahihirapan ako makapasok dahil sa record sa akin na "terminated" ako.

Pinapanalangin ko rin po na matapos na ito dahil papunta rin po ako sa ibang bansa para magtrabaho kase ako lang din po ang inaasahan ng pamilya ko.

Sana po ay matulungan ninyo ako tungkol sa usaping legal na ito ngayon po' nagpapasalamat ako ng malaki sa pagbibigay ng panahon basahin ang sulat ko.

Good day!

Opo, I did file a case against the company pero hindi ko pa rin po sigurado kung dapat ko pa po ba ituloy ang kaso or widraw ko na lang po...dahil yung nakausap ko po sa nlrc na representative ng PAO ay nagbanggit po na kailangan ko pa rin ilapit sa abugado yung tungkol sa nangyari.

Last Feb. 8, 2011 po first schedule po to meet between me and the company I sued with the presence of the law arbiter. Unfortunately, wala pong sumipot mula sa kumpanya. Tinanung ko po yung babae na andun na tingin ko po siya na yung assistant ng lawyer kung anu na po maaari ko gawin at kung kailangan ko na kumonsulta o kumausap mismo ng abugado kaso sabi po niya na antayin ko po kung ano mangyayari sa second meeting. I asked if the company will not show up again na kung ano pwede ko gawin, saka po niya sinabi na then I can get a lawyer from PAO bago pa lang ako dapat magpresent ng evidence to file and kung hindi ako sumang-ayon sa settlement.

Nag-aalala lang po ko kung sakali kase na ituloy ko ito at hindi naman valid ang kaso ay baka ako naman ang balikan ng kumpanya ko lalo na malaking kumpanya yon.

ill-lawterate, it's not uncommon that the company is absent at the first hearing.

Question
Can you file for constructive dismissal with the NLRC if you resigned due to an unpleasant working environment?

The boss is singling you out and have been treating you cold. The trust of management is gone because you testified against the Company in a police investigation - when they were trying to cover up an illegal act. Please advise.

IMO, while you can file for constructive dismissal, the burden of proof would be upon you.
