hi. in purchasing a property, what is the difference between juan dela cruz married to maria clara vs. juan dela cruz and maria clara are both owners in the title? is the property automatically belongs to maria clara since this is conjugal property? if it is written in the title that juan dela cruz is married to maria clara, what happens when juan dela cruz dies, is the property automatically belongs to maria clara, and she can sell it? hoping for a reply. thanks

If the title states X married to Y, this gives rise to the presumption that the property was acquired during the marriage and thus belongs to the absolute community or conjugal partnership of gains and the owner spouse cannot dispose of the property without the consent of the other.
