Pahelp naman po regarding sa Back Pay/Separation Pay. Kelan po namin malalaman na dapat may back pay ang company namin. Kasi po may mga nag resign na employee more than 5 years na pero wala silang nakuhang back pay.

Lahat ba ng company dabat magbigay ng back pay?

Anung legal action ang pwede namin gawin pag di kami nabigyan.

Employees who resigned ARE NOT ENTITLED TO SEPARATION PAY, unless company policy, the employment contract, or the Collective Bargaining Agreement says otherwise.

Kung lagpas 5 yrs na yan, tapos na ang taning para maghabol.

Ang minimum "Back pay" na pwedeng hingin ng empleyadong umalis ay:

1. sweldo para sa araw na pinasok pero hindi pa bayad
2. pro-rated 13th month pay
3. tax adjustment (ibalik ang sobrang buwis na kinaltas)
4. leave conversion (kung meron man)
