1 Solo parent rights on Sun Jun 18, 2017 1:16 am

I have a minor son, his father and I already separated for almost 5 years now. His father and I still dont have a good relationship with each other. For me his a toxic person that I can never forgive and I even cant stand his presence. His father also tends to be violent especially during arguements.  Even our child witness some of his outburts when we were still together and just recently last May 2017. He also insist that im the reason we got seperated. He still dont realize he also have a lot of faults why our relationship didnt work out. My son lives with me but my son's father and his parents also expects that during class breaks (summer & christmas) my son shall spend the vacation with them. I dont like this set up at all. I hate being away from my kid and having little communication with him when he is there. But my parents agreed to this set up since to show respect and a good relationship with their family. My son classes starts on Aug 1 but I already want to take him back. I want to know what are my rights. If I have the right to impose to them to bring back my son, what can I do if they dont comply and im also scared that if I take my child back his father will resist and show another violent acts. When I asked my kid before he goes there, he fully doesnt want to go but he feels that he needs to go. Do I have the right not to let them take my child during school break? Hoping for an answer and thank you for your time

1. Are you legally married?
2. How old is the child?

The biological father only has visitation rights. He has no right to custody of your illegitimate child.

You can ask that the visitation be limited accordingly and if he complains he will have to go to court.

In all you have to be reasonable.

You might have to face accusations of abuse or neglect if he consults a lawyer and goes to court.

In case the father took my child without my consent, what can I file against them?

Thank you again in advance.

Hi,

Me again. I just found out that my ex and his family is convincing my son to stay with them for good by telling not good things and not true things like when I get married and have a baby I wont love my son anymore. Is there something I could file against them?
