Good day po. Around 13yrs na kaming hiwalay o di nagsasama sa isang bubong ng asawa ko. Meron kaming isang anak. 2003 kami naghiwalay (not legally separated). since that time wala kaming communication at yung balita ko after 1yr binenta nya ang bahay na pinundar ko pero ok lang sa akin at di na ako naghabol dun sa bahay. Since my daughter is growing up at high school na xa, around 2012 nagkita kami by the help of some relatives and my intention is to support my daughter educational expenses which includes tuition fees, monthly allowance and other miscellaneous. Since my ex-wife wife got laid off from her job. Since then I financially supported my daughter and never missed though I knew that she got a new job but on minimum wage only. But as my responsibility. I need to support my daughter until she graduated college.
The problem is that I already living with other woman at meron na rin kaming anak na di alam ng ex-wife at ng una kong anak. Until lately they found out na may anak na nga ako at may kinakasama ng iba. Now they threaten me that they will file a case to me and they want to have me terminated from my work. Actually I am working abroad. Ano po ang dapat kong gawin? I just wanted to have a win-win solution. And by the can I also file a legal separation since we are not living together for more than 13yrs and on what grounds?

pwede ka mag file ng legal separation but hindi parin kayo pwedeng magsama nung "other woman". I think you're thinking of annulment

If you're thinking kung pwede ka nila idemanda for concubinage dahil may kinakasama ka, that is not possible because sa ibang bansa nangyari ang pagsasama niyo. Kaya walang criminal jurisdiction ang Philippines sa crime na nacommit niyo.

It is better that you file an annulment or declaration of nullity of your marriage. With legal separation kasi, there is no way that you could remarry. But you should always remember that before ka gumastos sa korte, lahat pwede pag-usapan lalo na kung ang ugat ay family prob...

Technically, the person who you are referring to as you ex is actually still your wife you have not yet had your marriage declared null and void or annulled.

Well, it is not only concubinage that you have to worry about. The provisions of Republic Act 9262 speak about psychological violence and mental infidelity as one of the punishable criminal acts of abuse.

As for legal separation, abandonment for over one year is a ground to ask for the same, but you are the guilty party here, to be honest, and only the innocent party can petition the court for legal separation.

Either you brave coming home and file your petition for declaration of nullity here in the Philippines, or, if you are already a naturalized citizen of the country where you are residing in now and that country allows divorce, ask for a divorce, if it is allowed under that country's rules.

1. You said you are living abroad, are you already citizen of that country by chance? If you are, you can divorce her and forward a copy of the divorce paper in the Philippines to have it recognise but this might take years. 🤗
2. She cannot sue you if you're living abroad as it is out of Philippines jurisdictions and most of all, in order to prove this, she has to caught you in the act living with someone, so that is impossible because you are in another country. 🙄
3. If you are already citizen, did you obtain dual citizenship? I hope not! 😳
4. Living abroad, if your child is over 18 they are no longer entitled for maintenance from their parents, you have good intention of helping your daughter but since you have been separated for 13 years, she should accept and realised by now that you are likely to have another family. 🙄
5. Like here in the U.K. we have a Deedpoll which allows you to change your name. Think about it! 🤔
