Hello!

My Name is Mark and I'm an OFW here in Ha Noi, Vietnam. I would like to ask for a help. Me and my girlfriend po kasi is kumuha ng bahay sa LUMINA-DUMAGUETE last 2015 pa. Nagbabayad kami ng on time and tapos na downpayment namin, actually sobra pa. The problem with the developer, wla pa din cla nasisimulan na bahay.. puro showroom palang. NExt is, 2x na sila nagpapalit ng subdivision plan. First pinachange nila unit namin kasi phase out na dw ung inoffer nila na ORIGINAL unit from AIRA magchange kami ng BETINA which is under BRIA Subdivision na and not from LUMINA (it's ok since sister company naman nila) na-OK na ung plan and nagchange nadin ng monthly amortization, papers, Notarized SPA , etc..

The problem is today. Nagemail na naman cla saying na need dw ulit magchange ng unit kasi need n nmn dw magchange ng subdivision plan. From BETINA need magchange ng ANGELI na unit and from LUMINA Homes change na nila subdivision name na BRIA HOMES.

So change na nman dw ng computation and change n nman dw ng unit. The problem is they keep on changing and now tapos na kami magbayad ng downpayment. Required dw kami magbayad ng monthly amortization na next month thru bank financing. Pero di pa kami nagaaply sa bank. Sa kanila dw muna kami magbabayad.


I just want to ask if is this legal? Need kami magbayad agad agad ng monthly amortization kahit hindi pa natuturn over ang bahay? or wala pa kami nakikitang naturn over nila?

Ok, ito lang din ang sasagutin ko.

LEGAL OR NOT? As long as nakasulat yan sa kontrata niyo, legal yan.
MONTHLY AMORTIZATION - Depende pa rin yon sa kontrata niyo. Wala kasing standard sa law yan. Ang application ng law papasok lang yan kapag wala kayong kasunduan kung kailan dapat. Dapat kung anong sinabi nila, gagawin nila. Kung sinabi nila na magtuturn-over before payment of amortization, dapat magturn over pero kung hindi, di rin...

CAVEAT: Yong ibang agents, ini-stress nila ang mga clients nila para di na tumuloy. Maka-cancel ang contract tapos ang nakalagay sa contracts nila ay 'prior payments shall be forfeited'.

Thank you so much Filia for the quick response. Actually madami na talagang issues and hindi namin alam if magtitiwala pa ba kami sa developer since first time buyer kami and hindi namin alam lahat ng pasikot-sikot. Nanghingi kami contract to sell but they said nasa Cebu pa daw ang ibibigay nalang dw samin pag nasa office na nila sa Dumaguete..

I presume you are Bisaya so magbinisaya na lang sad ko. Dapat atong pagbayad jud ninyo sa downpayment naa na moy contract to sell kay mao man gud toy basehan sa inyohang rights og sa ilahang obligation. Downpayment jud to inyo nabayran or reservation lang? Wa pa moy gipirmahan nga contract to sell jud or gibalik lang didto kay gipanotarize?

Actually girlfriend ko bisaya but kasabot man ko.. hehee Nakabayad na kami ng downpayment of 128k then next month we need to start na dw the monthly amortization ng house thru bank financing. Pero wla pa kami inaaplyan na Bank, sa kanila dw muna kami magbabayad. Ang contract to sell yes, nasa cebu pa dw for notarization cguro.. Kung hndi pa kami nanghingi ng copy last week di pa cguro nila aasikasuhin gusto kc namin malaman lahat ng terms and conditions..

Bank financing and in-house financing, iba ang rates dyan. Pag-in house financing may add-on pa usually yan. Mas maganda kung sa bangko ka or sa pag-ibig. I think, wala pa naman masyadong prob sa case mo kaya nga lang, di ko lang gusto yong papalit-palit ng units. Sa law, pwede ka naman talaga mag-insist na kung ano ang napagkasunduan, iyon dapat ang susundin nila kasi ang kasunduang verbal ay kontrata din, thus, it is binding between the parties. What they're doing can actually be considered a breach, unless otherwise, sabi ko nga kanina, kung ano man ang ginagawa ng housing company na yan, ay naaayon lamang sa kontratang napagkasunduan niyo o di kaya ay sa pinirmahan niyo. Usually, hindi ii-explain sa inyo yan at sa pipirmahan naman, masyadong malilit ang font size dyan kaya di mo na rin babasahin.
