Goodpm po ask ko lng po ang tito kopo una nkapangalan sa social housing nanay kopo ang nkabili noon pero pinangalan lng sa knya after 5 years binayaran sya ng nanay ko para iturn over sa akin ang lupa sa pamamagitan ng special power of attorney lease/purchase agreement. Ngayon full paid ko na po ung lupa gusto nya po bawiin ito at binibenta nman nya at inililipat nya sa pangalan ng tita ko. Ano po ang habol ko doon po? Pls need advice po.

Ngayon po daw ang nkapag pa titulo na sila ng lupa at ito ay nkapangalan na sa tita ko. Panu po yung pinirmahan nmin na special power of attorney lease/purchase agreement ? Ano po ang dpat kopo gawin

ang SPA kasi wala naman yan kinalaman sa bentahan. ginagamit lang yan para iauthorize ang isang tao na nag mag act on behalf nung nagissue ng SPA kung ano man yung naka saad sa SPA. meron ka bang deed of absolute sale? bakit hindi mo nilipat sa pangalan mo yung lupa nun nabayaran mo na?

anyway the best thing for you to do right now is hire a lawyer at reklamo mo yung tiyuhin mo. prepare mo lahat ng proof mo na binayaran mo yung lupa.

Ganito po iyon noong 2001 nkabili ng lupa ang aking tito sa social housing pagkaraan po ng limang taon ay binenta po niya ito sa nanay ko npagkasunduan na gumawa sila ng special power of attorney lease/purchase agreement noong 2006. Ako na po ang nagbabayad at noong 2009 ay na fully paid ko na ito . yung presidente po ng association sya po naglalakad ng papel dhil ready for title na ang aking lupa nkapag bigay na po ako sknya ng halagang 16k kulang pa daw iyon wla na po ako pera kya nagpasya ako na tska ko nlng lakarin ulit pag my pera na ako . eto lamang july 2017 bumalik ako ulit doon at napag alaman ko patay na ang presidente ng association at my bago na pumalit nkipag usap ako dito at ang sabi nka blue print na daw ang titulo ng lupa at nkapangalan ito sa tita ko na taga japan. Inilipat daw iyon ng tiyuhin ko sa tita ko nagkabayaran po sila. Panu po ung una namin npagkasunduan nka notaryo pa nman po iyon bkit po kya ito binalewala nila wla po ba ako habol doon?

Nkasaad po kc sa spa kopo
1. To represent the undersigned grantor and grantors spouse with the kapatiran village homeowners association inc in all matters relative to the property subject matter in the LEASE/PURCHASE AGREEMENT idenfied as doc. No. 207; page no. 42 book no. II; Series of 1997; in the notarial book of atty. Catherine b. Villa of imus cavite particularly for the purpose of getting the consent of the kapatiran village homeowners association inc in the causing the transfer of grantor's right, interest, ownership and obligations under the afore-mentioned LEASE/PURCHASE AGREEMENT to and in favor of the attorney-in-fact herein, to pay all expenses needed to accomplish the transfer and to sign all and whatever documents for the purpose.

2. With the above, the attorney-in-fact shall take over, henceforth, shall pay the monthly obligations under the terms and condition of said Lease/purchase agreement until it is fully paid. And thereafter, by virtue of this special power of attorney , the kapatiran village homeowners association, inc. Is authorized to deliver, turn over and execute the required DEED OF ABSOLUTE SALE on subject property directly in favor of the named attorney-in-fact herein including power to transfer grantors Lease/purchase agreement

3. This special power of attorney is intended to remain valid, binding and enforceable between the grantor, grantors spouse and the attorney-in-fact herein and their respective heirs and successors-in-interest until the above are accomplished.

Indi kopo nailipat sa pangalan kopo dhil nun time po na iyon ayaw ng presidente ilipat kailangan daw po pumirma ang tiyuhin ko pero ayaw po nya magpakita at ayaw po nya pumirma.

if that is the case mukhang niloko ka nga ng tiyuhin mo. mas maganda na kumuha ka na ng abogado kasi since nakapangalan na yung lupa sa tyahin mo, ang habol mo dyan is panagutin yung tyuhin mo.
