Hi Atty,

Need your legal advise regarding my situation. I rendered my resignation last June 5, 2017 and it will take effect on July 5, 2017. I was able to go to work from June 5 up until June 14. My rest day was thu-fri I was not able to report to work since then because of unexpected circumstances. I have 3 kids a 9yo, 7yo, and 3yo. Umalis na po katulong ko April. Mejo Ok pa saken yung pasok kasi bakasyon kaya di ganun ka-hassle. Dumating po asawa ko May 14 from abroad bakasyon lang po sya for 1mo. Pero yung bakasyon nya is more on training nag-undergo training po sya during his vacation. Training sched nya po was from 12nn-8pm sa Guadalupe we are residing in Cavite. My shift starts 10:30pm-7:30am. Mejo Ok pa ang lahat nung bakasyon not until school started. Pasok po ng mga bata 2 sa kanila from 6am-12nn and yung bunso 3pm-6pm. Asawa ko po nag-aasikaso sa umaga nagpapakain, naghahatid-sundo sa dalawang pang-umaga. Pagdating ko po sa bahay ng 9am ako na po nakatoka. Pakain sa bunso, prepare for lunch, hatid sa asawa ko ng 10am sundo sa mga bata ng 11:30am tapos ako na po nag-aasikaso lahat from the time ng lunch tapos asikaso sa bunso ko at 2pm pinaka pahinga ko lang po is yung time from 3pm-5:30pm tapos sundo ule sa bunso. Kasama ko mama ko po sa bahay Pero working din po sya sa isang NGO sa Panay Quezon City. Umaalis po mama ko 4am in the morning dumarating sa bahay between 6pm-8pm. Nakakapag-asikaso lang po ako sa sarili ko going to work pagdating ni mama kasi sa kanya ko po iniiwan saglet mga bata hanggang sa dumating po asawa ko. Yan po routine ko everyday fr Monday to Wed ang off ko po kasi ginagamit ko sa paglaba, linis ng bahay and everything. Nakaya ko po yan from the day nagstart ang school until June 14. Aware po ang supervisor ko at OM ko sa sitwasyon na meron ako. June 15-16 normal rest day routine ko laba, linis di na po Ok ang pakiramdam ko that time Pero pinilit ko pong tapusin lahat ng Gawain ko sa bahay pag hatid ko po sa bunso ko sa room June 16 ng 3pm paglabas ng room napansin ko na wala na po yung fon siguro dahil sa pagod di ko naramdaman na nahulog na sya sa bulsa ko and nagmamadali din po ako umuwe kasi makulimlim nainiisip ko mga sinampay ko. On my home bigla po bumuhos yung ulan so in short naulanan po ako. June 16 po din po yung alis ng asawa ko pabalik sa abroad and naihatid pa po namin sya sa airport. Dahil di na Ok pakiramdam ko plus the pagod nilagnat po ako kinagabihan, sakit ng ulo and katawan di na po ako nakapasok ng June 17. Di ko po nagawang mag-inform dahil wala nga po akong fon contacts lahat andun Pero June 20 po pumunta ako ng office para maghatid ng sulat explaining to my TL yung nangyari and nagpaalam na rin po ako na di ko na matatapos i-render yung 30days gawa ng wala na po ako katuwang sa pag-aasikaso sa mga bata. From that time I haven't heard din anything from my sup ni di rin po ako kinakamusta or anything wala. June 26 nakabili po ako ng bagong fon. June 30 payday po namin pag check ko po sa ATM ko wala pong laman. So nag-login po ako kinabukasan sa epayslip po namin and that's the time I found out na nakahold ang sahod ko po and I was tagged absconding. That same day kinausap ko po sup ko sa fb asking sorry but he's no longer willing to listen, he asked me to stop explaining and he said he's done I even told him na nagbigay ako ng sulat sa asawa nya sana nabasa nya and his response was he doesn't care anymore with what i am going to say. July 4 po nagmessage ako sa isang OM namin about my situation. He was surprised because they only knew that I just left. They don't have any idea about the letter I sent to my supervisor . Yung OM po namin binigay number saken ng HR namin to tell everything. So tinext ko po yung HR namin and I found out na may admin hearing na pala ako ng July 10, 2017. HR said they sent a return to work order by mail na wala po ako narereceive. And HR informed me na na cancel daw po yung resignation ko because of my absences. Gusto ko lang po malaman kung makatarungan po ba yung decision nila saken, tama po ba na i-cancel nila yung resignation ko ng ganun-ganun na lang. Despite the fact of the circumstances na pinagdaanan ko at pinagdadaanan until now? Atty I need your immediate reply po bago po sana dumating yung admin hearing ko. May laban po ba ko just in case? And can you help me find a lawyer na makakatulong po sa kaso ko just in case me laban po ako? Thank you po and God bless.

they cannot cancel your resignation, what they can cancel is their acceptance of it. meaning if nakapagrender ka sana ibig sabihin wala ka ng responsibility sa company. dahil hindi ka nakapagrender ng full 30 days may karapatan ang company na ihabla ka for damages.

i would advise you to just seek a win-win solution. baka willing silang tapusin mo nalang kung ilan pa ang kulang sa 30 days. yung tungkol sa bata or kung nagkasakit ka, although it might be a legitimate excuse for being absent, its not an excuse para hindi mo ifullfill yung 30 days

Nakapagrender naman ako di ko lang natapos. And if they will allow me to finish yung days na kulang ko it will be impossible for me to do it kasi wala po mag-aasikaso sa mga anak ko. Gustuhin ko man tapusin yung 30 days ko pano naman mga anak ko pano pag-aaral nila. From the time na umuwe na yung katulong ko naghanap nako ng kasama sa bahay pero ang hirap. Lahat ng kakilala ko, kakilala ng nanay ko wala silang makuha.

hindi mo natapos so hindi ka nakapagrender ng 30 days. Like i said basta hindi ka nakapagrender ng 30 days then the employer can sue you for damages. How much will be decided sa court. Sa merits mukhang talo ka but not all employers sue naman and if they do, you can hope the court rules in your favor for "humanitarian" reasons.

How about po sa resignation ko that they cancel. Admin hearing ko po this July 10. I don't have any idea bakit nila kinansel yun according to our HR they cancel it because of my absences. And pano po yung huling sahod ko na pinagtrabahuan ko po? Will I ever get it? A attend po ako ng hearing ano po ang best option ko.

they can cancel their acceptance but they can't cancel the resignation itself. Hindi ka nila pwedeng pilitin na magtrabaho if ayaw mo na. They most they can do is sue you for damages. technically dapat makuha mo yung sahod mo but ang problem mo is magiging AWOL ka and hindi ka makapag process ng clearance. Without your clearance mahirapan ka kunin yung last pay mo although dapat nilang ibigay sayo yun.

you can always file a complaint sa NLRC but if hindi mo kayang tapusin yung natitirang days mo, how can you find time to attend the hearings

Atty they accepted the resignation already last June 5 that's why inadvise ako ng HR na kinansel nila resignation ko due to my absences daw po.

Nagtanong tanong po ako sa ilang dating kawork ko po na nagkaron ng same situation. Dun po sa mga nakaattend ng hearing they will just ask you kung bakit di daw nakakapasok. To some, nabibigyan sila ng clearance pero di na raw nila nakukuha yung back pay nila including last pay. The admin hearing will only took 10-15mins daw po. Ang admin hearing ko po is scheduled at 10pm. Makaka-attend po ako pasok naman po ng mga bata is 6am-12nn and 3pm-6pm. Update po kita sa mangyayari.

Hi atty.
Hihingi lang po sana ako ng advice or opinion nyo po kasi po nagfile po ako ng resignation last march 16 effectively on april 16 di po ako nakapagrender ng 30days in reasonable part po na may sakit po kasi ang mother at wala pong magaasikaso. Tapos po etong july 7 may dumating po na letter of termination sa akin. Nakagawa narin po ako ng written explanation sa company. Ano po ba ang dapat kong gawin para makakuha po ako ng backpay? 5yrs po ako sa company.

Nakagawa po muna ako ng written explanation sa company bago ko po nareceive ang letter. Tapos po pinagcclearance parin po nila ako. Paano ko po ba masisigurado na maibibigay po nila yung backpay ko? Pwede din po ba ako magfile ng complaint sa nlrc?

walang separation pay if nag resign ka or if na terminate ka. pero kahit awol entitled ka parin sa last pay mo (yung sweldo ng huling pasok mo), pro rated 13th month at kung meron kang unconsumed leaves

pwede ka mag file sa nlrc pero ingat ka if nag file ng case for damages ang employer mo kasi hindi mo tinapos yung 30 days. if manalo sila malamang mas malaki ang amount kesa sa last pay mo.
as long as na turn over mo kung ano ang mga kailangan and wala kang pending na utang or gamit na dapat isauli dapat ka bigyan ng clearance.

May pinanghahawakan po kasi akong letter of termination considered AWOL po ako dahil di ko po natapos yung 30days. Pero nakagawa na po ako ng written explanation sa kanila at pinagcclearance parin po nila ako. Pag nakapagclearance po ba ako may rights parin po akong makuha yung lastpay ko?

Paano po kapag hindi nila ibinigay yung lastpay at igigiit po nilang naforfeit po lahat ng benefits dahil awol po ako at terminated, pero pinagcclearance po nila ako. May rights po ba akong ilaban eto?

Kung di nila ibigay last pay mo, magreklamo ka sa DOLE. Walang karapatan ang company na mag-forfeit ng benefits mo at mag-deduct ANY AMOUNT sa last pay mo (unless specified sa contract mo).

They would have to file a case against you first to recover ANY AMOUNT from you. Kaya ni piso ay di nila pwedeng gawin yan.

Tell them, na since natanggap nila ang resignation letter mo, di nila pwedeng iconsider ka na AWOL or i-terminate ka for Job Abandonment kasi merong resignation letter.

Di ka din nila pwedeng piliting mag-render ng 30 days as the same is only a suggestion and not mandatory. This is against INVOLUNTARY SERVITUDE. The Philippine Constitution prohibits this.

Hayaan mong idemanda ka. Wag ka matakot, civil case lang yan at hindi ka makukulong. Hayaan mong gawin nila ito para patunayan nila yang forfeiture nila sa benefits mo. Kung di sila magsasampa ng kaso e wala silang basehan at karapatan kunin benefits mo.

Ang Korte lang ang pwedeng magsabi kung pwedeng singilin ka ng kumpanya mo at Korte din and magsasabi kung magkano.

Wag ka matakot. Protektahan mo sarili mo.

Paano po ba kahit wala akong copy ng resignation para katunayan po pag nagreklamo ako sa dole kapag di po nila ibinigay yung last or bawasan po nila? Pero may pinanghahawakan po ako na letter of termination considered awol daw po ako dahil di po ako nakapagrender ng 30days pero pinagclearance parin po nila ako?
