Good day po. Bago po ako sa website na to or forum dahil naisip kong hanapin ang kasagutan sa issue na nangyari sakin noong aug. 20. May tanong lang po ako about sa nawalang laptop na naka assign sakin. Nag resign na kasi ako sa company at ibabalik ko na ang laptop. Ngayon, itong laptop nawala dahil tinakasan ako ng kumpare ko at dinala ang buong bag kasama ang mga damit, etc. Nag file ako ng police report at binigay sa employer almost 3mos delay kasi ang printer ng station police ay sira at late nang inayos. Sa huling usapan namin ng employer, ikakaltas ito sa final pay kung magkano ang matira. Ngayon, ang nangyari po ay, meron akong deficiency na less than P3,000. Sa ngayon po kasi wala pa akong work at nag email sila sakin na sasampahan nila ako ng criminal case or estafa kung hndi ko bayaran within five days ang kulang. Bakit sila magsasampa ng kaso kung may document naman akong pinadala sa kanila? Please po. I need clear explanation for this. Thank you po at asahan ko ang sagot ninyo. Regards. Rnm.

moderator
protect yourself by filing an actual complaint against your friend in the prosecutor's office. it will be better if you pursue a case against him so you can show you were sincere in saying the laptop is lost.

in my opinion, you are liable for the cost of the laptop. the company will try to make it into a criminal case so that you will pay.

Thanks po sa immediate reply. Ang problem po kasi yung kumpare kong hilaw hndi ko totally alam ang address. Palipat lipat kasi yun ng address. Nung pinuntahan ko ang dating bahay na alam ko, wala na po sila dun.

Dun po naman sa employer ko, mababayaran ko naman po sila kaya lang sa April pa ko makakuha ng allowance. Ang gusto kasi ng collection agency within five days since nung thursday. Wala naman ako intention na pabayaan ang nangyari to think na ang cost ng laptop sa market today is just 50% sa dapat na makuha kong final pay. Hndi naman po ako abnormal na ipagpapalit ko ang halaga ng P20k na separation pay for example para lang sa P10k na laptop.

Question po ulit, pwede ko bang sabihin sa collection firm na wala akong pera ngayon so April ko pa ma settle ang kulang?

Hi po ulit. In addition dun sa question ko, will it affect my nbi record if we say they filed a criminal case against me before settlement of remaining balance even nakiusap na ko sa kanila? Thank you.

you can allege his last known address. that will be sufficient.

yes, you can tell that to the collection agency but no guarantee they will agree to it.

if a warrant of arrest is issued it may be recorded in your nbi record.

now that you mention a collection agency, i doubt if any case will be actually filed.

Hi po attorney. I will send a reply to the collection agency telling them for my propose date of settlement. Inform po kita about their response.

You mentioned about warrant of arrest, possible po ba yun na magpapa issue ng warrant of arrest ang employer or collection agency sa halaga ng asset na mababa sa P3,000 knowing na may communication naman ako sa kanila?
