Good afternoon po,

Just would like to ask po if tama ang pagkakaterminate sa akin ng office? At ano po rights ko dito? Ganito po kasi ang kwento:

March 2017 po ako tinanggap as Probationary employee. Actually, galing po ako sa sister company ng Presidente namin for 10years in the office. Ang tamang term po is lateral transfer kasi kinausap ako na lumipat kasi kailangan nila ang service ko sa kabila. But of course i need to resign muna sa kabila para lumipat dito. At lahat yon na settle naman ng maayos. I only signed a letter of welcome sa company plus compensation breakdown without the "made known" standards. sabi sa akin "verbally" ay mga 3-4 months or maximum of July pwede na akong ma regular kasi matagal naman ako sa sister company at kilala na ako. And only yesterday, kinausap ako ng GM namin na hindi na raw ako mareregular kasi hindi daw ako fit sa standard ng company. The letter indicates the reason as only "terminating your probationary status... due for not meeting the Company's Standards". Wala po akong nagawang kasalanan sa company which will fall doon sa "just or authorized causes" ng Article 282 ng Labor Code. At wala ring prior letter or letters stating my offense or warnings para sa akin. Basta termination na agad. My 6 months will end on Sept. 16, 2017 but the termination is on July 31, which is 7 days after the termination letter. Di talaga ako prepared especially finacially pero wala naman po akong magawa.

Yan po ang kwento ko. I hope you can enlighten me kung anong rights ko at ano ang dapat kong gawin.

dapat po ba 30days notice ang termination? nasa labor code po ba yon kahit probationary employment lang?
