Good day,

I'd like to seek an advice regarding my current situation. Im currently working as a Corporate QA in a manufacturing company for more than 2 years. 3 months ago, may bago kaming department head. A month after she took over the position, we already heard rumors na madidissolve yung corporate and malilipat kami sa plants.

We were already disturbed with what we heard from other people and issues were raised. Because of this, she gathered us up last Aug 8 for a meeting and told us the following:
a) we have new organization structure and was already approved.
b) not all of us will be retained in our current position.
c) the person that will not be retain will have the following options:
1. Will apply in plants since we have a lot of vacancies
2. Will apply in other dept. where we are fit
3. To leave the company with package of monthly pay times years of service.
d) we will be assessed according to competency, behavior and attendance.
During this meeting, nasabi din masyado kaming madami para iretain lahat sa position.

Aug 22 she told us the verdict. Isa isa kaming tinawag. When I was called, she told me directly the options na pagpipilian ko which is the mentioned options 1 and 2 wherein I was so shocked na hindi na ako nakapag-isip ng matino. At nasabi ko na option 1 yung pipiliin ko since may malapit na planta sa bahay. Pero tinanong niya ako kung ano yung gusto ko sa career path ko, sinabi ko din naman. In which, option 1 is sort of a demotion on my part since yung magiging trabaho ko will be an entry level but the job grade is the same. Option 2 I will start again from scratch since iba na yung nasimulan ko sa career ko. Then, sinabi niya na pag isipan ko muna dahil yung level ko.

Aug 23 actually natauhan po ako, and naisip ko yung labor code which was way back college pa. I wasn't so sure even after na nabasa ko ulit yung labor code since vague or general po yung nakastate. Since then, I've decided na aalis.

Aug 24 kinausap ko yung immediate superior ko. Tinanong ko siya kung ano yung reasons kung bakit ako maalis sa corporate. She replied na dahil sa competency ko. Compare sa mga kasama ko hindi pa ako naimmersed sa ibang function (dalawang group kase kami dati. Feb 2016 lang kami nagmerge as a group. Pero walang nagawang transition to other functions kase kulang sa tao dahil may nagkasakit at nagresign and sobrang tight na yung schedule. Wala ding trainings na naibigay). Sinabi ko sa kanya na hindi ko kasalan yun at ginawa ko yung trabaho ko, just because of new organization structure biglang mawawalan ako ng trabaho dahil mag-iba na ng focus. Sinabi ko po na, I might leave nalang with the package which is the mentioned option 3. Then, sinabihan ako na hindi na daw yun kasama sa options. Binawi daw ng Department Head namin.

Aug 30 kanina nagsabi na ako sa IS ko na aalis nalang since hindi na magiging harmonious yung environment ko and I feel like na nademoralized ako. Another thing, wala din namang vacancy na sa malapit na planta and if I choose it para din akong nademote and I dont think na people will respect me. Tinanong ko ulit kung meron pa yun option 3. Ang sabi sa aking pinag uusapan pa with HR. Probably daw wala na talaga. Di pa po ako nagpasa ng resignation letter and nakadepende daw sa akin kung kelan ko gusto which is parang floating na yung status ko.

Yung sinabing Org structure na bago wala pa pong binababa sa amin kung kelan yung effectivity pero approved na po.

Wala pong documented notice na binigay sa akin at wala pa ding final date kung hanggang kelan nalang ako. Nakahang po lahat since yung dept head namin next week pa babalik from ob.

Naguguluhan po ako if my current situation is valid as redundancy, retrenchment or constructive dismissal. I actually do not know na po kung anong gagawin ko. I planned to talk with the HR pero po kase diretso sa VP which is corporate lawyer. I have to seek advice po sana muna bago ko siya harapin and if valid din ba na may makukuha akong claim.

At ano po yung dapat kong gawin?

1. if dinisolve nga yung corporate then they can place you on floating status without pay for 6 months. after 6 months and they cannot find an appropriate position for you then they have to give you option 3.
2. if retrenched or nasama sa redundancy, they have to give you option 3.
3. constructive dismissal only happens when pinahirapan ka sa work para umalis ka. eg pinag linis ka ng toilet even though manager ka. sinisigawan ka ng manager araw araw. pinapa strip search ka sa guard bago ka umuwi. exaggerated yung mga examples ko but i think you get the idea
4. if gusto mong magmatigas, you can refuse option 1 and 2. if ni terminate ka then you can file for illegal dismissal, then bahala na kayo mag argue kung competent ka nga or hindi.
5. if ni assign ka sa dif postion without your consent, you can file for constructive dismissal but unless na very obvious na nilipat ka lang para mag resign ka then you will probably lose your complaint.

Hindi po ba tantamount to:
1. Breach of contract or constructive dismissal, if nahire ako as Corporate QA Auditor (job grade 7) tapos biglang pinapili na magplanta which is QA Analyst or mapunta sa ibang department which is Research and Development.
*QA analyst 1 - job grade 6
QA analyst 2 - job grade 7
Both, walang mawawala na benefits pero entitled to shifting schedule, overtime and may saturday na po.
*RND, will start from scratch. Job grade 7. Wala na sa career path na gusto ko.
Wala po kaming job description dito sa corporate but definitely yung ginagawa namin is to audit our plants, suppliers, etc. If mag analyst po, yun po yung entry level sa QA.
2. Redundancy or retrenchment, na nagbago ng org structure tapos inalis ako dahil masyadong madaming kaming auditor. And wala din siyang luxury of time na magtrain since "kulang" yung experience ko para sa bagong function. Pero po kase Meet expectation po ako sa KPI/Performance Appraisal, CAF, etc. Bali lapses din po nila kung bakit di sila nagbigay ng training at halos puno yung schedule. Nakaplan po iyon na within December 2017 yung target for us na mafully trained kami sa lahat ng function. Pero pumasok yung bagong head nung May 2017 and nagbaho ng org structure na hindi pa namin alam kung kelan yung effectivity.

1. hindi nga, kasi pinapipili ka nga. if sila ang basta nag assign sayo then you may argue na that is the case. (hindi mo ata binasa yung sagot ko)
2. ano ang question mo regarding #2?

for example ikaw ay admin staff, tapos nilipat ka at ginawa kang receptionist without your consent unless mapapatunayan mo na ang paglipat sayo ay para sa purpose na pahirapan ka para ikaw ay mapilitang magresign, matatalo ka complaint na constructive dismissal
