Thank you sa lahat ng sasagot.

Meron kami employee na found using the petty cash upon do the surprise audit.

Eto kasi yung tinamaan niyang violation sa Handbook namen. First offense is DISMISSAL.

2.01 Stealing, misappropriating or embezzling Company Funds or Property.
(Pagnanakaw, paglulustay o paggamit ng walang pahintulot ng pondo ng kumpanya o alin man sa mga pag-aari nito.

Ngayon she filed a complaint in SENA for illegal dismissal and asking for separation pay.

Ang due process na ginawa ng HR Dept.

1. Served the NTE and Preventive suspension for 15 days, on the 8th day the HR has a result already and served the Notice for termination.

May laban po si company sa mga ganitong case?

Notice To Explain and Preventive suspension dated aug 10
The employee reply aug 11

Aug 18 the company served the notice of termination

based on what you have stated dapat wala but baka sa psecifics may mga mitigating circumstances. did you ever report this to the authorities? this is qualified theft if it can be proven

Ahh okay. Nung nalaman po na nag audit dated Aug 9. Then NTE ang PS served Aug 11. On Aug 11 binalik po niya yung kinuha niyang pera. Okay lang po ba yung ganun? Then, sabi po niya sa explanation na na hindi niya naman kinuha yung pera tinabi niya lang daw. Pero meron po kaming mga witness and they also accomplished written explanation.

hindi pwedeng magnanakaw ka tapos pag nahuli ka ibabalik mo na lang yung ninakaw mo.. tama lang na materminate sya..

Ang sabi po ng NLRC dahil lang daw sa 600 dismissal daw agad?
Diba kahit ano namang amount ng kinuha basta walang paalam ay pagnanakaw?

Yun din ang dahilan ng Top Mgt. were not talking about the amount but the trust and confidence. Aware din siya na pwedeng ma dismissed once na-violate yung ganung rules. Every year silang ino-orient regarding company policies.

Nagkaroon ba ng admin hearing?

After serving the first notice, the employers should schedule and conduct a hearing or conference wherein the employees will be given the opportunity to: (1) explain and clarify their defenses to the charge against them; (2) present evidence in support of their defenses; and (3) rebut the evidence presented against them by the management. During the hearing or conference, the employees are given the chance to defend themselves personally, with the assistance of a representative or counsel of their choice. Moreover, this conference or hearing could be used by the parties as an opportunity to come to an amicable settlement.
