Hi to all.
I just need advice or guidance on whats the legal matter for transferring the land. Yung house and lot po e nakasanla with interest. My father just passed away and didnt left any will. He just talked to me over the fone to get ung titulo ng lupa. Pero second family kami, ung father ko e legally separated dun sa una nyang asawa. Meron akong kuya sa unang asawa ng papa ko. Panu po ung hatian ng property na naiwan ng papa ko. Meron akong copy ng marriage certificate ng father at mother ko pero is it valid kung legally separated sa unang asawa. Gusto ko lang po malaman ang right ko sa lupa kasi kung ako ung tutubos ng lupa ba nakasanla tapos ung kuya pala sa unang asawa ng papa ko mas malaking karapatan sa kin e siya na lang dapat magbayad nung utang ng papa ko. Ang kaso po e wala din pong ipapambayad ang kuya ko. Gusto ko lang po malaman ang magandang approach na madidivide and property ng papa ko equally sa lahat kaming magkakapatid.

Lahat kayong mga anak ay may right over the properties of your father. You can discuss among yourselves kung pano ang hatian nyong mga heirs then you can execute extrajudicial settlement of estate dividing the properties. Kung may mariage contract ang parents mo, ang presumption is legitimate child ka with full share. Illegitimate children ay nakakakuha lng ng kalahati ng share ng legitimate na anak.

Just to add on karl704's comments. since legally separated lang sa unang asawa tatay mo, technically hindi sya pwedeng maikasal sa nanay mo so keep that in mind. kung ilaban yan ng unang family ng tatay mo para palabasin na illegitimate ka at kalahati lang ng mamanahin nila ang dapat mong matanggap.

imho, bago mo bayaran yung pagkakautang ng tatay mo ay gumawa na kayo ng malinaw na kasunduan para hindi magkagulo once matubos mo yung property.

Assuming na hindi valid and marriage certificate ng parents ko at assuming na illegitimate children kami ng siblings ko, Panu po ang magiging hatian ng property, dalawa sila sa unang asawa at tatlo kami sa pangalawang asawa? 50% for two at 50% sa three?

Wala silang means para matubos ang lupa so panu at anung kasunduan ang dapat kung iraise bago ko tubusin ung property?

Kindly advise po ng best approach and thank yoi o much in advance for the answers.

just to make it simple, sabihin natin na si legitimate child ay entitled sa 100k na mana, si illegitimate child ay entitled sa 50k lamang (half of what the legitimate child is entitled).

regarding sa sitwasyon nyo, i would advise hire a lawyer para matulungan ka magdraft ng kasunduan sa ariarian.

Nasa abroad po tatay ko bout 20 yrs ago. Pinakiusapan po nanay ko ng kaibigan nia na duon cila tumira sa tabing lote namin. Tapos nagpatayo na cila ng bahay hanggang ngaun nandun pa rin cila. Sabi ng tatay ko wala naman daw cyang pirma kung naibenta ni nanay sa kanila. Maari po bang hatiin ang lote. Kung naibenta po ni nanay parang condugal. Please advice. Thank you po.

Never po naming gagawin kay nanay.. Ci tatay ang may gusto malaman kung may karapatan pa ciang kunin ang kalahati ng lote. Nag aaway po kasi cilang makapitbahay ngaun. 82 yrs old na c nanay c tatay nam po 77 yrs old na. Kaya matatanda na po at d alam ang karapatan nila. Wala naman po kaming alam gaani sa batas kaya gusto po naming malaman kung nakaka apak na po kami ng karapatan ng ibang tao. Sabi po kasi ni tatay gusto nia kunin kalahati na loteng pinagtauan nila ng bahay. Natakot naman kaming magkakapatid baka makulong pa cya .ipinabaranggay na po kasi cia ng dalawang beses kasi ayaw ng kabila na mag bigay ng daan kaya sabi ni tatay kanya pa rin daw kalahati. Dun sa lote.kung tutuusin. Anu po bang legal na paliwang para kay tatay at kabila para magkaayou po cila. Nung tinanong po namin c nanay sabi nya nagbigay ng dalawang libo yung kaibigan nia sa kanya tapos tapos nagpatayo na ng concrete na bahat sa tabi namin. Ngaun lang po napag uusapan ngaung matanda na cila kasi ngaun lang po ung conflict nila sa daan. May daanan naman po pero nagalit lang si tatay kasi ung kanila nalang ang wala sa linya. Lahat kami magkakapit bahay hanggang dulo pareho ang luwang. Pagdating sa kanila makipot mahirap mag maneobra ng sasakyan paglabas ng gate. Wala po saming magkakapatid un, pero para kay tatay at ibang kapitbahay hindi patas. Anu po ba ang karapatan ni tatay duon para maipaliwang namin sa kanya ng mabuti. Thank you po

#Ronelde Hi, I am not a lawyer but only want to share my little knowledge to you. If your father was ONLY SEPARATED from his 1st wife, your father's marriage to your mother, although you have a Marriage Certificate it maybe considered invalid unless the 1st marriage was NULL and VOID. Assuming the 1st marriage is valid, then their 2 kids are the legitimate heirs, and you 3 kids are illegitimate heirs. Since the property was on loan by your father, the payment could be considered as Liabilities of the Intestate estate of your father. The cost including unpaid realty taxes or amilyar, estate tax, documentary tax, transfer tax, cost of litigation, litigation, administration fees, lawyer's fees, news publication fee if Extra-Judicially settled, etc. should be all deductible from the sale proceeds of the property. This can be agreed upon by you all 5 kids by executing an Extra Judicial Settlement Agreement (read the Rule 73 & 74 of the New Rules of Court). As to the computation of each heir's inheritance, Family Code of the Phil states the legitimine share of an illegitimate child is ONE HALF of an legitimate child. Actually, we were in the shoe when our parents passed away and tatay had 2 illegitimate kids. Ladie

#Ronalde in continuation, there 3 methods of computation of the inheritance ( the remaining sale proceeds after deducting all the Liabilities of the Intestate estate of your father). To think of how much each heir receives cannot be determined until how much was it is sold and how much pa matitira after inawas na ang lahat ng bayaran at gastos...Ladie

#Ronalde... if you don't intend to sell the property but rather to partition or subdivide it among yourselves, the same computation will apply maybe instead of value of the property, number of squaremetage be used and the DENR maybe requested. However, because of the improvement there in (house) you will have another problem. Ladie
