Mr A died.

Mr A had 4 children - A1, A2, A3 and A4 are the heirs of the undivided state.

The 4 heirs divided their fathers state and claim their share but no extra-judicial partition.

Each four shares already had a lot number in the local assessors office.

Mr A2 sold his share to a stranger Mr X by the year 1968, with 'Absolute deed of sale of real rights' with notary and stamps.

Mr A2 executed an affidavit of confirmation so that his 3 brothers will sign to separate his share for the purpose of separate tax. But only A1 did not sign.

Mr X paid his tax c/o Mr A

Mr X, A1, A2, A3 and A4 died already. Only their children work for settlement.

QUESTIONS:
How can the children of Mr X be sure they will own their father's share?
Is there a possibility that the share of Mr A2 can be taken by his children?
What other possible scenario can happen?

Reclusion Perpetua
is the title of the land already under the new owner or still under the old one? if the latter, i would advise have it updated to have the title bear the name of the real owner of the land.

Gum am po. kami ay heirs ni Mr X yung nakabili sa share ni Mr A2. sa ngayon midyo hindi na magkasundo ang mga heirs ni Mr A1 at Mr X because they believe na masmalaki ang share ni Mr A2 yung nabili, at yung apat nilang share sa mga anak ni Mr A ay may cadastral survey na at landmark noon pa. kaya ang anak ni Mr A1 ay nagpasurvey ng naturing lupa (divided by 4) pero ang share lang namin (nabili ni Mr X) ang nakunan ng malalaking portion at napunta kay Mr A1 at agad-agad nilagyan ng landmark. and we believe hindi fair ang pagkakahati dahil hindi na ngayon isinama sa hatian ang portion naidonate ni Mr A1 sa barangay ginawan ng barangay hall at Mr A1 lang ang nagperma hindi alam sa ibang heirs ni Mr A, at dapat kasama na yon sa share niya.
at kung iyong pagsurvey ay para magkaroon ng extrajudicial partition pero hindi nila kami sinabihan, walang presence ng ibang heir ni Mr A.

Q-
Pwedi ba silang magpagawa ng extrajudicial partion na sila lang mga heirs ni Mr A? paano na ang share ni Mr A2 na nabili ni Mr X? ano ang participation namin dito (heirs ni Mr X) sa paggawa ng extrajudicial partition?

Ano ba ang pwedi naming gawin dito mga heir ni Mr X?
