Hello all,

I just need to ask about legal matters. It is about my marriage. I got married 2008 but before the marriage my wife and I is already living together for more than 3 years and we have 1 child aged 2 years old before the wedding on 2008. When we got married there was a problem of the marriage contract up until now. I have 2 first names and in the certificate it has only 1 name. we got married with the help of a religious group but the papers for the marriage were processed through a tribal way. We're not part of any tribe and no seminars happened. We just signed the papers. The marriage certificate is now recorded in NSO. I have a copy already. 6 years after the wedding my wife confessed that he got involved in a relationship with a married man during the time that we're living together with our son that aged 2 years old that time. I just recently knew it. Would be the marriage considered as invalid because of the way and the processed of the wedding. How about what my wife hid from me? would that be a ground for an invalid marriage? Please help I'm in deep confusion right now. I'll be waiting for your response as soon as possible.

even if your marriage can be declared void, only the court have the authority to do this. hire a lawyer to assist you with your case.

1. Check your marriage contract again and see under which exemption to the marriage license requirement you fall under.

2. As to what your wife hid from you, that is not a ground for the declaration of nullity of marriage.

Thanks for the quick response, I'll check the documents.

We are not part of any tribal group but it was a religious group with the the help of NCIP who processed the papers. We did not get any CENOMAR or attend any Marriage seminars for a marriage license. We are from Agusan del Norte and the Tribal Office is in Agusan del Sur, a different province. It was the Layman who processed it and gave us the documents to sign it. Do I have a chance to void the marriage? If there is what is the percentage of the chance? and How much it will cost to process it legally? Can I ask help or assistance from a PAO lawyer? I'm just a minimum age earner and still supports my family up until now.

Sorry for a lot of questions.

Well there are exemptions as well regarding the distance constraints that would render obtaining a marriage license impracticable.

Hi This is the situation, A husband and B wife is married and had one daughter. B which is the wife decided to leave the country and abandoned his husband because she is not happy anymore so she took her 8 mos baby with her and went to Brunei to her mother's place.
A the husband was so angry because he didn't know about it and they didn't return for a year so the husband decided to file for annulment Nov 2016. Now A has a girlfriend and B has a boyfriend and she's here in the Philippines already. She doesn't want to accept any financial support from the husband because she doesn't want the husband to borrow the child or introduce him as the father. Now, A and his girlfriend is already pregnant with their first child but not living together. Can the wife file a case to husband and the mistress? how? and what are the evidences? Thank you
