I had been annulled as of 2009. Right now I am processing a fiance visa and would want my kids to joint me abroad carry my fiance's family name once we get married ( as his adopted children ). they are still carrying his fathers name this time. I did not ask the court to do the favor when I was still processing my annulment for the respect of their biological father who in turn all through this years had not shown any concern for them. And so I had thought that it is no use carrying his name. My fiance had told me he wanted the childrens family name to follow his after our marriage. What is the best thing for me to do now? Should I try to get this all done first while I am still here in the Philippines? What are the processes I have to go through to have heir family name changed? How much usually is the fee in doing this?

what was the basis for annulment? on what ground?

The ground was psychological incapacity. He had not supported my children ever since 2008..nor he visits them. I had not sought for them to change their name when my annulment was on going thinking that no matter what they are his children. But for that duration of time he had not done anything to reach out on my children. I figured it out that my children are living a life now like they don't have an biological father at all. I asked my kids if they want to visit their father, by my children doesn't like to be around him. They even were asking me if they can disregard using their fathers name. I now want to start a new life. And I hope they can start a new life too. the question is:

1. What will I have to do to legalize their surname change?
2. How will my fiancée, ones we get married legally adopt them?
3. How much is the fee to have their surname changed?

i agree with dulangan that your better strategy is to marry your boy friend, and if possible, migrate your whole family to his country. It may be easier under his laws to achieve your objectives through their process of adoption.

your children are considered your ex-husband's legitimate children, and you will need his consent for your husband to adopt them. if you do the adoption here, there is a residency requirement for your husband to live here for several years.
