Hello good day, i will just ask po. If the employee is monthly, during the special non-working holiday kung hindi po siya papasok, bayad pa rin po ba siya?

just as long as the employee worked 1 working day prior to the holiday.

i.e work ninyo is monday to friday, and holiday is on a monday, dapat pumasok ka friday (1 working day prior to the holiday)

Meron po bang katibayan yun na pwede namin ipakita sa boss namin? or papel na pwd ipakita sa kanila?

Hi po. Ask ko lang po san ko makita sa DOLE yung rules about monthly paid employees. Saka pano ko po mlaman kung daily or monthly paid ang employee? eto po kasi company namin, ang bayad lang ay yung 3 special holiday at hindi inohonor any declared special non working holiday. Daily daw kami pero monthly naman nakalagay sa contract when we signed the offer. Yung po kasing handbook, more on daily wages kasi sya. Please help and advice. Thank you.

Sa monthly employees, ang binibilang lang talaga kung ilang araw ang absent since they are considered paid for the whole month. computation for their salary will be monthly divided by two (half a month pay) then less for the number of days they are absent.

Sa daily paid employees, ang binibilang ay ang mga araw na pinasok kasi binabayaran sila doon sa pinasok nila, that's the reason for no-work no pay.

daily employees if they did not report to work on special holiday, are not included in the payment for special holidays, "No Work No Pay"

Regular or legal holiday, as per law all employees are entitled to 1 day pay if unworked.

Thanks for the reply and the article.

Is it right for my company to say that they pay the 3 special non working holidays and because of this, they do not pay us additional 30% for any special non working holiday declared by the government with reasons that they pay us for the 3 special non working listed holidays when it should be no work no pay? We are monthly paid employees. I thought this rule is only applicable for daily paid employees. Is it really a discretion of private companies if they will pay their monthly paid employees for declared special non working holidays such as APEC etc? Thanks.

hi po.. magtatanong lang.
halimbawa po sa special holiday..applicable po ba dito yung dapat pumasok ng before para mabayaran yung holiday nya? or if di po pumasok ng before pero pumasok during the holiday ibig sabihin po ba byad parin yung 30% nya? or yung normaal pay lang kase di sya pumasok ng before the holiday.

second question po is during regular holiday
halimbawa po na di pumasok si worker ng before the holiday pero pumasok sya sa mismong holiday 200% parin po ba ang byad sa kanya or 100% lang kase di sya pumasok ng before

example po na daily basis worker ito.

To make it clear:

Scenario
1. di pumasok ng day before special holiday October 30

walang baya ang October 30, 31 and November 1

2. pumasok ng October 30

Regular pay October 30
Holiday pay (x130%) October 31 and November 1

*kung ikaw ay daily paid - wala kang bayad pag di ka pumasok ng October 31 kahit na pumasok ka ng October 30


3. di pumasok before regular holiday Nov 30 (Bonifacio day)

walang bayad Nov 29 and Nov 30

4. pumasok before regular holiday Nov 30 (Bonifacio day)

Regular Pay Nov 29
Holiday pay (x200%) Nov 30

*kung di naman pumasok ng Nov 30, may bayad pa din ng 1 day.
