Hello , I would like to seek legal advice. Kasi nakareceive ako ng Memo for written explanation bakit hindi ma reach ang quota. Pero yung binigay nilang quota is impossible to reach and June this year nila binigay pero fiscal year ang usapan so dapat sa May pa sila mag pa NTE. We were put to preventive suspension yung isang sales 30 days yung isa 15 days. Is it working days or calendar days kasi wala po naka specified sa Memo. Thank you.

are you sure its preventive suspension? Usually kasi pag hindi na ka reach ng quota punitive ang sanctions. Just to clarify, hindi lahat ng suspension preventive

Preventive suspension is NOT a penalty, so hindi dapat preventive suspension ang ni-impose sayo ng management. Try mo basahin to, para mas maintindihan mo yung nature ng preventive suspension. Sana lang makatulong. https://www.alburovillanueva.com/discipline-suspension-termination

Thanks for your reply. Yes preventive suspension. Yun nga din ang pinagtataka namin. Tapos hindi kami pareho ng number of days ng suspension.Actually, wala naman talga nakakaabot ng quota nila dito. Then ang style ng management pag gusto na nila paalisin ang tao kung ano anong memo ibibigay nila unproductive and now with suspension na. Plus surprisingly nakahold ang commission. Legal po ba yung ginagawa nila? Actually nag tanong na rin kami sa lawyer pero ang advice need na matapos ang PS then tanungin ang investigation na ginawa nila.

Im planning to resign sana kasi nakaka degrade yung treatment nila. Pero for sure hindi nila babayaran yung separation pay. Plus, yung accusations nila is mali.

no separation pay talaga basta resignation. advise lang, you should start looking for another job, if accurate ang kwento mo, parang malapit ka nang tanggalin

Hello po. Ako po yung isang sales n binabanggit ni bi_twins. My preventive suspension started last Nov. 17 and matatapos sana ng December 27. But the management sent the Notice of termination s bahay namin last December 6. Legal po b ang ginawa nila? May inaaasahan pa naman saan akong benta before mag end ang year. Syempre nagtatatrabaho pa rin ako kahit na suspended ako to prove na hindi ako nagpapabaya s trabaho ko. Sad lang ako kasi ang pangit n ng record ko at sila na ang  makikinabang ng commission ko kadi nga terminated na ako. Sana po mabigyan nyo ako ng advise. Salamat po.

Hello po. Ask ko lang po sana tulong nyo. Tatlo po kami tao sa sales kasama na ang boss namin. Nakatanggap kami ng preventive suspension ng kasama ko. Ako 30 days immediately at yung kasama ko 15 days due to not targeting our quota s isang product na binebenta namin.Pero sa history po ng company nobody po ang naka meet ng quota. May copy po ako ng collection report at base s collection report yung boss po namin nakabenta ng 2.9M, ako po 2.8 at yung kasama ko ay 2.2M. Sa isang product naman po ang benta ng boss ko ay 58K, ako 2M yung kasama ko ay 125K. Binigyan nila ako ng time na sumagot why no disiplinary action such as termination due to non targeting my quota. Nagtataka lang po ako 5 days after ko magbigay ng written explanation sa preventive suspension na binigay nila s akin kung bakit hindi ko naabot yung target ko. Binigyan ako ng immediate termination ng boss ko. Pero yung kasama kong isa s sales nandoon pa rin sya sa company at hindi pa rin nya na serve yung suspension nya. Anu po ba tamang proseso s pagterminate ng employee. May laban po ba ako s kanila kung magsasampa ako ng kaso s NLRC? Salamat po s nga sasagot at sana matulubgan nto ako.

Yes, may laban ka dapat sa NLRC, kasi mukang hindi nasunod ang twin notice rule sa pagterminate sayo. https://www.alburovillanueva.com/dismissal-termination-employment
