Arresto Menor
married and no-prenup,
marriage not going great other party infidelity,

want to buy house/lot through a loan,
plan is to get the capital,
give capital to someone or family member who will be the one buying and signing the deed of sale, who will also make another deed of sale in my favor

will there be a legal complication on this?

Hello po,

1. Under the law, family member (or someone) is recognized as the registered owner of the house/lot.
2. Even if the DOAS is in your favor, note that all properties you may acquire during the marriage (if you are not legally separated or there is no judgment of nullity) are community property - and your spouse will have his/her share in it.
3. Unless you file for judicial separation or legal separation, your spouse is your beneficiary, and has equal share in the proceeds of properties you may acquire now and in the future.
