Arresto Menor

A person is completely naked at the backyard of his/her private house. The house is surrounded by an 8-foot perimeter wall in all sides.

Can his adjacent neighbor charge him/her indecent exposure (or any sexual offense) in the following scenario:

a. The house of the adjacent neighbor is a bungalow type (ground floor only) that he had to climb the wall to see the naked person.
b. The house of the adjacent neighbor is two floors and he saw the naked person from the window of the second floor.

IMHO, no since she was naked on her own home. I believe the person who peeped on her is more liable.

Also no. The best they can do is speak with the neighbor and request from her to put curtains or something so that not everyone will have full view of her "assets". You can pursue further action if you can prove that she has malicious intent on her actions.
