naterminate ako due to serious misconduct. what happened was nagkaroon kami ng arguement ng isang employee din. and during our arguements sinabi ko "anong problema mo? ayusin mo tono mo" and "gusto mo sa baba tayo oh. tara". those words were taken against me kasi I was challenging the other employee for a fist fight daw that's why they terminated me. nagfile ako sa NLRC and hndi sila sumipot nung 1st SENA.

may laban po ba ako kasi subjective ang pagkakaterminate sakn and wala nman clear reason/proof na hinamon ko ng fist fight not threaten ung another employee. thanks sa sasagot.

Hello po. Pakitulungan po kmi ng kawork ko. nasa bpo po kami. Under preventive suspension po kmi effective nov. 22 until now dahil s serious misconduct. Sharing of password po s computer log in. Pero wala nman po kmi na impose n threat s finacial at s company kasi wala nman po kaming dishonest avaya log ins. Isa pa pong factor ung vague n company policy nila about electronics communacation policy po nila. Yung misconduct pi nmen na observed lang at wala kahit anong first warning o coaching naiserved that na we are doing something worng. Dahil kahit po mga superisora at mga supports ganagawa yung sharing of password s loob ng department namen. Sa dec. 12 po yung release ng 13tg month pero hindi po kami nkasama s mga bibigyan. 6 years and half n po ako ngwowork s company at may good records. First time po ngyari sken to pakitulungan po kami kung paano ang magandang gawin. Salamat po.

Where you given a notice to explain, 5 days to submit your explanation and given notice of termination?

Yes po atty. Process was followed. May laban po ba ako in questioning their reason for terminating me being subjective given na no solid proof na I was challenging the other employee for a fist fight?

You were given a time to explain in writing.. what is your explanation? was there a witness to what happened? where you given further opportunity to explain? did you contest their result?

yes po. I was given 5 days to explain then admin hearing. may mga witnesses po and they mentioned that the tone of the other employee was too commanding and condescending given his rank. and the witnesses confirmed that I did not challenge the other employee for a fist fight. I did not contest the result because I was not given a chance to do it. They said it's final. may laban po kya ako? Hndi sila nag attend ng 2 SENA and naka sched sa Jan 15 ung first hearing ng formal complaint na nifile ko.

From what I see, they observed due process.

Case - Serious Misconduct - maybe coming from a complaint of "Harassment" filed by the "complainant", your co - employee, who is 1 rank lower than you.

First, let me orient you on "harassment" case. Usually, this case stemmed up from what the complainant "Feel", meaning kung na feel nila na harass sila, pwede silang mag file ng complaint. sometimes kahit ka buddy mo na siya at matagal na kayo pero 1 time sa pag bibiro ninyo na feel niya na "harass" siya or in this case, "na takot" siya dahil feel niya hinamon siya ng suntukan, or baka aabangan mo siya later, pwede siyang mag file ng complaint.

For you it's subjective, but for the management it is serious. You are 1 rank higher than him, and this could be seen as a conduct of behaviour not suitable for someone of your rank to show to those below your rank. that's why, for those of higher rank, the penalty is much severe given to the offender.

Now to answer your question, lahat naman may laban, it will all depend on what evidence the company have, but since they did the due process, they have the most chance of winning.
