Dear Atty.,

Gusto ko lang sana humingi ng legal advice tungkol sa problema ko sa Money card. I left my money card loan unpaid for 5 years. Nagpunta po ako sa ibang bansa. Hindi po ako sinuwerte makahanap ng magandang sahod kaya bumalik na lang din po ako at hindi ko rin po na settle ang money card ko. Last year nagkaroon po ako ng intention na magbayad pero dahil po sa laki ng halaga na gusto nilang bayaran ko(50,000.00) di ko po nabayaran. Ngayon keno contact po nila ako uli at pinababayaran po uli sa akin ng 25,000.00, or else sa court na daw po ang kaso. Wala po ako talagang salapi na ganoon kalaki. Beside wala po akong income sa ngayon at umaasa lang po ako sa kita ko sa avon. Kasalukuyan po akong naghahanap uli ng work at possible po naman dahil may mga interviews po ako next week. Gusto ko pong maayos na ang problema kong ito at willing po akong hulugan monthly. Hindi ko po intention na tumakbo sa obligation ko nagkataon lang po na wala akong pambayad sa ngayon. Ayoko na rin po umabot pa sa court ang bagay na ito. Ayon po sa nakausap ko subject for raffle na daw po ang kaso ko. Ang credit limit ko lang po ay 20,000.00 pero ang pinababayaran po sa akin ay 380,000+. Makatarungan po ba ito.
Ano po ang action na dapat kung gawin sa bagay na ito. Ano po ba ang batas na nakasad sa mga ganitong kaso.

Lubos po akong umaasa sa advise at opinion ninyo.

i assume this is some form of credit card?

there is no question that you are liable to pay for your purchases. the credit card company will not easily allow a reduction of its penalties and interest, but I would say that there have been cases when the court reduced it 2% a month.

Do not change residence or office address without informing the credit card company, but you can change your contact details if you don't like being harassed. I believe you are dealing with a collection agency

Sir/Madam,

Hindi ko po kaya ang hinihingi ng collection agency. Dapat po bang dumirikta ako sa banko para makipag-usap para sa payment ko. Pumayag po kaya ang banko na monthly ang bayad at kung magkano lang talaga ang kaya ko.

Hihintayin ko pa po ba ang decision ng court para magfile ng appeal na maireduce sa 2% ang interest rate?

Gano po katagal ang decision kung sakali na pabayaan ko na mag proceed sa court at ano po ang worst na senario.

Sorry po sa mga tanong ko pero wala po kasi akong alam about mga legal matters kaya po ako nagtatanong ng mga bagay bagay.

yes, you can talk to the bank directly. If they actually file a case, I don' recommend you just ignore it. You have to convince the court to reduce the interest and penalty.
