Hi good day, just call me Mars, I just want to ask if it is legal that the salary disputes shall be carried over to my back pay (that, as per Hr, it will be released after 45 days of after the completion of clearance) if the employee was been termed? The first time I got dispute, they released it after 2 days. In my case, the second time around, they did not same the same procedure on my third dispute complaint, but instead they add it up on my back pay. Please help me

Your speaking of clearance. It is assumed that you are already separated from the company. In that case, all monetary claims shall form part of your back pay and the same is legal.

No Atty. I did not yet process my clearance and the dispute came from last cutoff period of payout. Will that still be the same?

Are you separated from the company already? If so, this would form part of your back pay.

If not, do not speak of back pay.
