Hello po. Hinge po sana ako ng advice sa situation namin ng mga kasama ko sa office po. Regular na po kami, ako 2 years nang nagtatrabaho dito ang iba po may 3-5 years na din. Kaya kami tumatagal kasi hindi tinataggap ang mga resignations namin pag nagsasabi kami sa boss namin na magreresign kami. Kaya po yung iba, mag a-AWOL na lang para makaalis sa companya. Kahit ang HR wala pong magawa kasi family ng boss namin ang may-ari ng companya. If we are to file for our resignations, we are not even sending it to HR since nasa boss pa rin namin ang final say. And then hindi po after 30 days ang nilalagay namin na effectivity nung resignation letter namin, mahigit 3 months pa po. Ano po ba ang pwede naming gawin para hindi po umabot sa pag AWOL or ABANDONMENT? Sad

Tell your HR to read up on the Article 285 of the labor code.

(a) the employee may terminate without just cause the employee-employer relationship by serving a written notice on the employer at least 1 month in advance.

Thus with this, the employer cannot state that he/she will not accept your resignation, cause that would lead to involuntary servitude.

What you can do, submit a resignation letter to your boss or the hr, and bring a witness. make sure that there are 2 copies of the letter (1 for you and 1 for your boss/hr). State that you will be resigning and if they refuse, write in both copies, refuse to receive and have your witness sign it and leave a copy to them. Your 30 days start from there. Render your 30 days and you should not be tagged as "AWOL / Abandonment of Duty".

Now if he's asking you for more than 30 days, it should have been in your policy before your resignation. If he's forcing you to do so, ask for it in writing.
