Hi,

Gud day. Ask ko lang, nagsend ako ng solo parent leave request, but it was declined kasi ang reason sa request ko ay 'vacation'.
Makatarungan po ba hindi nila bayaran ang 2 days ko dahil lang sa maling term na yun?
At totoo naman na nasa bahay lang ako nung mga araw na yun at inaalagaan lang ang 3mos old baby ko?

they won't accept dahil ang 'vacation' reason daw ay for vacation leave request lang. at dahil sa hindi ako pumasok ng 2 days, nagkaroon pa ako ng written warning/memo.
please note that i requested the solo parent leave 1wk before the requested date, it was approved by my manager, but the payroll declined.

Sa leave form ba, naka sulat ang # of days na mag leave ka? may vacation leave credits ka ba? yung leave form may pirma ng manager?

sa leave form indicated yung dates, Dec 27 - 28,
no more VL credits kaya SPL ang ginamit ko since the year is about to end, i need to use my remaining SPL credits.
yup, may pirma ng manager ko.

So that answers your question - "Makatarungan po ba hindi nila bayaran ang 2 days ko dahil lang sa maling term na yun?" - which is yes.

You wanted to file Solo Parent Leave but you made the mistake of filing it as a Vacation Leave. You don't have a vacation leave credit so there is no pay for it. Since you don't have a VL Credit, it will fall as leave without pay.

sadly, there are many gray areas when it comes to the solo parent act. if you really want to contest it, file a complaint at the nearest dole office

I clearly filed it as a Solo Parent Leave but the reason i put is vacation. My point is that, why did they approved the request, they should have denied it in the first place when they saw my reason as 'vacation'. Is it really my fault or theirs?

1) its your fault because You can only use a solo parent leave for the reason of your children and not vacation. you should not have put vacation. even if its approved by your superior, then if HR can see that it was wrongfully filed then he would not process it.

anyway, you should just write a letter to the HR to explain it to them.also, as AttyLLL stated you can contest it in the nearest DOLE Office
