Good day!
Ask ko lang po advise nyo regarding po dito:

1. Naka-probationary contract po si Employee A until January 16 at Employee B until January 30.
2. Narecived na po sa HR ang evaluation nila and based po doon ay hindi sila nakapasa o na-meet yung standard ng company which is alam naman nila nung pinapirma sila ng prob. contract.
3. gusto ng employer na hindi na sila i-extend at tpusin na ang knilang contract.
4. ang isang reason po kasi is hindi po sila nag-papaalam ng maayos kapag mag-aabsent kaya nag kakaproblema sa shifting ng ibang katrabaho nila.


Ang tanong ko po ay kung okay na po ba yung kakausapin sila at iinform na sa ganoong date sila mag-eend o may iba pang dpat gawin?

update lng po. may right po ba si employer na wag na papasukin si Employee A khit hndi pa tpos yung prob contract ? kasi pinapapasok sya para mag-duty pero ayaw nya. Nung una, Nag-oo naman sya na papasok sya pero nung oras na ng shift niya ay ayaw nya pumasok.

That would be tantamount to preventive suspension and that can be done only if the employee presents a clear danger to the employer. You can instead initiate termination proceedings if there is a clear just cause for termination

kung ayaw pumasok ng employee kahit pinapapasok siya ng employer, start doing the due process for awol, so that it will be on record na dapat pa siya pumasok but he refuse to do so.

The management followed your advise to give them notice for termination stating the reason and the employee accepted it .
