Arresto Menor
hi! i need your advise re my
situation. I am 7yrs
separated and dont have any
communication with my husband.
He's not giving any financial
support to my kid from the very
beginning of our separation.
Cau\n I file nulity of marriage
instead of filing annulment
since I dont hear anything
and in his family?

moderator
separation and failure to provide support, by themselves, are not grounds for nullification of marriage. i recommend you have your marital docs and history reviewed by a legal professional.

This is just an idea.

You mentioned that you haven't heard from your ex-husband for the last seven years. Perhaps he is already dead. Maybe not, but in the eye of the law he can be. You can petition a court to declare your husband presumptively dead. If annulment is impossible because there's no ground to justify it, this can be your last hope.

And also, write to your congressman and ask him to support divorce. It's right about time that our lawmakers should realize the necessity of this law.
