gsto ko po malaman kng may sense ba ang gsto kong mangyari. ganito po kasi yan,we have a child involved in this situation pero hndi kami kasal ng ex ko. ngayon, pg nagtetext ang ex ko sa lalaki nya, sinisiraan nya ako, sasabihin nyang hindi na daw kme nagkabalikan. pero kng ako na ktxt ng ex ko, hndi na daw sya nag tetext dun sa lalaki. which is, absurd. alam ko nmn na either saming dalwa ng ibang lalake nya eh nagsisinungaling sya. ang gsto ko nlng mangyari esecure ko yung anak ko. does it make sense if ipapasummon ko silang dalwa sa baranggay lng muna? eto kasi advice ng kaibigan ko sakin.kasi i dont have the right to file a case against my ex and the guy cus me and my ex are not married. thanks po in advance.

the mother has sole parental authority over an illegitimate child. visitation rights lang ang meron ka.

so hindi po pwde na mag request ako na epapa summon sila sa baranggay ng ex ko at ng kabet nya pra sa kapakanan ng aming anak?

what you are legally entitled to are visitation rights. you can ask them to the bgy and try to reach an agreement as to a schedule and your obligation to provide support

Pwede po bang humingi ng visitation rights ang father? Ganito po kasi ang story. 1st 3 years ng bata nasa poder ng tatay. Forcibly taken ng nanay ang bata without consent ng tatay pero nakuha naman na so wala na magawa ang tatay. Dinala sa ibang bansa at sinabihan ang tatay na after 1 month isoli ang bata. So the father have to agree kasi estopped na siya. Pinahiram ang bata kasi isasama na pala yung mother at ipapakilala sa parents ng new bf niay dahil magpapakasal. Ibinalik ang bata according to what was agreed. Nagpakasal ang mother sa ibang lalaki. Hindi married ang father at mother ng bata in the first place. Nung week na ikakasal ang mother ng bata, ang tatay pinuntahan sila dun sa ibang bansa kasi sa ibang bansa man magpapakasal ang nanay. Both nanay at yung pakakasalan are Filipinos. Yung tatay mismo pumunta so that arrangements will be made pertaining sa welfare ng bata and with the hope na makakuha ng visitation rights. Not granted by the mother at lalo pang inilayo ang bata sa tatay. After sa kasal ng nanay hindi na alam ng tatay kung nasaan ang anak niya so what he did was naging OFW dun sa country na alam niya nakatira ang nanay at ang anak niya. No child support was given kasi ayaw tanggapin ng nanay. Ayaw dun ng nanay na bigyan ng viaitation rights ang tatay ng bata. Now, nagmessage ang nanay at pinapapirma ng insurance papers para daw sa bata pero lumalabas na papirmahin siya na pinapa adopt na niya ang anak niya dun sa husband ng. Kung hindi magpirma they will go thru the lagl adoption process and declare na giabandon ng tatay ang bata. Pwede ba ito without the knowledge of the father. No communications for a long time kasi kahit mag message ang tatay hindi sinasagot nung nanay ng bata. Efforts were made to locate his son. Sumulat pa sa embassy ang lola nagpapatulong pero wala pa rin. Question: pwede ba sabihin ng nanay na gi abandon ng tatay ang anak for 5 years dahil wala silang communication even without the fault ng father?
Pwede ba diretso i adopt ng step father ang bata without the step father talking to the natural father of the child? On what grounds pwede ma declare na abandoned ng father ang child when i n fact ang in deed acknowledged ng father, may affidavit of support, beneficiay ng father sa SSS and PHIC amg anak niya. Gusto niyang suportahan pero itinago ng nanay sa ibang bansa.

if the mother alleges abandonment, he can submit proof that it is not true if he can find out where the adoption case was filed.
