Hi good day.
I was living together with a partner for 9 years. Di po kami kasal. We have a son na 6 years old na this coming july. May asawa po sa una yung nanay ng anak ko and may 3 kids sya sa una. Last sept 2016, na petition po sa US ung nanay ng anak ko. Since wala n po mg aalaga sa anak namin while im at work lumipat po ako pabalik sa parents ko. Ung anak po namin is nagaaral n ng pre school this time. Kaya pag weekdays nasa tita nya sya who is also his teacher sa school and susunduin ko po sya ng weekends.
Dec. 2016 po is nag stop n po mg reply s mga msgs ko ung nanay ng anak ko. Wala po syang sinabing dahilan. Ako naman po tuloy lang sa routine ko kasi gusto ko po mkapag aral pa rin ung anak ko. Di naman po ako ng duda sa nanay ng anak ko kasi alam ko kasama nya sa bahay sa US ung nanay nya at kapatid nya. Ngkakausap po unganak ko atmama nya thru sa mga kapatid nya sa namay. Tinuloy ko lng po ung routine ko without speaking sa mother ng anak ko.
Jan. 2017 nung sinundo ko po unf anak ko, nagkwento sya bigla na pinapakausap daw sya ng mama nya sa kay rolly. Dun ko n po nalaman na may ibang lalake na pala yung mama nya. Yung anak ko po ngkwento ng lahat sa kin.
Itinago po ng family ng nanay ng anak ko sa kin na may iba na pala syang lalake at magkasama na sila sa bahay.
May mga common friends po kami n kinausap yung nanay ng anak ko and nalaman nila na nov. 2016 pa lang ay lumalabas na sila ng nanay ng anak ko. Dec. 2016 which is the same time n tumigil sya pag msg sa kin e ngsama na sila nung lalake. Sabi dw ng nanay ng anak ko na pinalayas daw sya ng kapatid nya at nanay nya.
Since jan 2017 di ko napo binalik sa kanila ung anak ko.
Tanong ko po is ano po ang rights ko bilang tatay sa anak ko kung nanlalake yung nanay nya?
Mako consider po bang abandonment ung case n ihahabla ko kc ng cut ng communication ung nanay nya? Di rin po ng bibigay ng support ung nanay nya sa kin. Ako po gumagastos sa school at sa lahat ng needs ng anak ko.
Mako consider din po b na immorality case to since nanlalake po ung nanay ng anak ko?
Ano po pwede case ang pwede ko i file kasi di nakipaghiwalay ng maayos unf nanay nya.
Up until now, di po nkikipag communicate nanay ng anak ko s kin khit nasa akin n ung bata.
Itinago po daw ng mga tita nya ung passport ng anak ko at ibang legal documents and ayaw po nila ibigay sa kin. Mako consider din po ba na theft yung ginawa nila?
Mahal na mahal ko po ung anak ko and ayaw ko naman po na sa mga tita o kapatid nya sya iwan.

unfortunately, since hindi kayo kasal ay wala kang karapatan sa custody ng bata. pwede ka magsampa ng reklamo against sa nanay para patunayan na unfit sya para alagaan ang bata pero hindi parin sigurado na sayo igagawad ng korte ang custody ng bata since typically sa next of kin ito inaaward.

what you can do is adopt your child kaso kailangan mo ng basbas ng nanay nya para magawa mo ito.

May nabasa po kc ako na ground for exception ang abandonment at immorality sa unmarried couples custody rights. So di po b to pwede mgamit n basehan for custody?

This is of course not without exceptions. The Supreme Court has enumerated instances when a mother may be deprived of the custody of her child, but these are only the most compelling of reasons. In Briones vs. Miguel (G.R. No. 156343, October 18, 2004), the court said:

“Only the most compelling of reasons, such as the mother’s unfitness to exercise sole parental authority, shall justify her deprivation of parental authority and the award of custody to someone else. In the past, the following grounds have been considered ample justification to deprive a mother of custody and parental authority: neglect or abandonment, unemployment, immorality, habitual drunkenness, drug addiction, maltreatment of the child, insanity and affliction with a communicable disease.”

If any of the foregoing exceptions apply to your case, you may file a Petition of Custody with the court where you reside or your child resides to gain custody of your child.

As previously mentioned, kahit pa matanggal mo ang custody ng nanay through court proceedings, hindi automatic na sa tatay iaaward ang custody ng bata. Pwedeng sa lolo at lola nya. You would have to prove na sa poder mo pinaka mapapabuti ang lagay ng bata.

arlan, if you believe you can prove one of those grounds in court then your recourse is to hire a lawyer and file a petition for custody
