Hello po. Ask ko lang po if may legal action dito.
Resigned na po ako sa last company ko, may COE na and clearance.
Then after a month po, I received a message sa fb galing sa HR ng company na may discrepancy or sobra daw sa back pay ko.
Di ko alam kung ibabalik ko ung sobra or hindi since nagastos ko na ito dahil nasa hospital ang father ko.
Kaya gusto ko po makahingi ng legal advise para dito, sabi po kasi ng iba wala na silang habol dun dahil may document ako na cleared na ko sa company pero ayun nga po, gusto ko padin malaman ung legal na paraan.

yes meron they can file a case to get it back. and kahit wala silang habol you should never keep money that doesn’t belong to you

Based on the concept of 'Unjust Enrichment', may karapatan and kumpanya na kunin ang sa kanila. Ika w mismo nagsabi na sobra ang ibinigay nila, ibig sabihin hindi sayo ang sobra. Walang kinalaman dto kung nagastos mo o may clearance ka o wala, kung idedemanda ka para makuha yan e pwedeng gawin yun.

How much ang sobra? Dapat ibalik mo.. ngayon kung nagastos mo na, ask them if you can pay it in installment.
