Hello,

Pwede mkahingi ng advice.
Ikakasal na sana kami ng parner ko ngunit pagkuha namin ng Cenomar nia naka lagay dun ay kasal na siya 2003 pa . Inamin naman niya na parang nagpakasal siya dati nung kabataan niya kasi nabuntis yung girlfriend nya. gusto ng parents ng girl ikasal sila. at nung nanganak yung girl sa hospital may pinapirma sa knya para ma lagay yung pangalan ng bata sa knya ng isang lawyer at iyon na pala ang kasal. pinalakad lng ng lawyer. Lahat yun ay nangyari sa hospital lang. Hindi siya sure hangang ngayon kung kasal ba iyon. Pero willing siya pakasalan iyong girl na yon before. Di rin naging maganda pagsasama nila after napanganak iyong bata pinalayas siya ng parents ng girl at pinapirma siya ng document pra mapalitan iyong family name ng bata back sa family nane ng girl. At ngayon pinatry ko sa knya na kumuha ng marriage certificate pero hindi makita ito sa PSA at mag aantay daw ng 3 weeks to a month para sa feedback. Malaki po ba ang chance na ma void yung marriage nila? Tsaka ano bang mga steps na gagawin namin para po ma process iyon?

unfortunately, kahit pa voidable ang kasal at papabalabasin na shotgun wedding ang nangyari eh meron lang sya 5 years from the date of marriage para contest yung kasal sa korte. Kung gusto nyo maipawalang bisa ang kasal, kakailanganin nya magfile sa korte ng annulment or nullity (whatever may apply to his situation). una nyang kelangan gawin ay kumuha ng abogado.

even though they did not go through marriage seminar at walang marriage license at proper process yung marriage ay d pa rin voidable?

Even if it is clear that the marriage is voidable, only the court can declare such marriage void. Hence, a case would still need to be filed.

the only plus if the marriage is clearly voidable is that the case proceeding will go much quicker.

Do you know how long (estimate) will that take? Given if it is really voidable?

if the evidences are really strong, it may take about a year depending on the load of the court that will handle the case.

My bf just went to get the marriage cert. And there's no record of him that he's been married. Does that mean there was no marriage happened at all by law? How do we update his cenomar so that it will be fixed? same process?

Check with the main office of PSA and bring the cenomar. If they cannot produce the marriage certificate, they can clarify why cenomar is not being issued if there was no recorded marriage.

There is a world of difference between voidable marriages and void marriages, and I believe that his marriage is void. https://www.alburovillanueva.com/annulment-nullity-marriage Walang marriage license, walang naganap na marriage ceremony, walang authorized solemnizing officer (kasi nga walang ceremony in the first place), which are all requisites to make the marriage valid. Problema nyo lang talaga yang cenomar na yan, kaya i-try nyo munang kumuha ng CERTIFICATION from the civil registrar attesting to the fact na walang record na sya ay kasal na. Kung hindi parin sapat yung certification para ma-update yung cenomar, then ipa-declare na nya sa korte na void yung previous marriage nya.

Only a court could declare a marriage void. If there was no marriage to begin with, but there is a record of it somewhere in the system of the Philippine Statistics Authority, your remedy is to have that marriage declared void.

Hi ask ko lang po ngpakasalan po ako sa isang american citizen after ng civil wedding nmin 1 month lng kme ng sma tas bmlik n xa sa u.s gang sa ngkhiwalay n kme tpos po nong time po n ngpkasal ako 20 lng po ako non ung parents consent ko po walang notary legal po b marriage nmin? Tapos anu po pwdeng process para mapawalng bisa kasal nmin thnks po

Dapat i-file mo na yung annulment case bago ka mag-26 years old, kasi yung ground for annulment na lack of parental consent pwede lang syang i-file within 5 years after you reach 21 years of age. https://www.alburovillanueva.com/annulment-nullity-marriage
