atty need advise,
a friend of mine talked by his immediate supervisor and told him that magbabawas daw ng tao sa company nila, and isa nga sya sa mababawas, question;
1. required ba syang tapusin yung 30 days period notice kung sya naman ang tinanggal?
2. 12 years na sya sa company, iba po ba ang rate kapag sya ang tinanggal at offer ng company 100% per year of service?
3. may tax deduction pa po ba yun?

1. the employer will notify your friend 30 days in advance that he/she will be redundated
2. 1 month pay per year of service

just to clarify things, when the emplyer informs you, it means it will terminate your services 30 days after. so kelangan mong pumasok. make sure you do kasi if hindi ka pumasok baka gawing grounds to terminate you.

Regarding No. 1: Since this is redundancy, it is the employer who should observe the 30-day notice period before kang tuluyang tanggalin sa trabaho mo. https://www.alburovillanueva.com/authorized-causes-termination-employment Based sa tanong mo, baka lang kasi ang iniisip mo ay yung 30-day notice period ng employee pag nagreresign. Iba yun. Ganun pa man, since employed ka parin until mag-take effect yung redundancy within 30 days, subject ka parin sa rules ng kompanya which includes attendance and punctuality, kaya kailangan mo parin talaga pumasok.

If it's redundancy, there should be no tax.

"Any amount received by an official or employee or his heirs from the employer as a consequence of separation of such official or employee from the service of the employer because of death, sickness or other physical disability OR for causes beyond the control of the said official or employee"

nakuwento pa ng friend ko sa akin na , since 12 years na sya sa ofc, pakiramdam nya hindi sya paaabutin ng 15 years , kasi po mag 2 months pa lang yung new superior na, hinahanapan na sya ng mga butas sa work nya, yung hinahanapan sya ng pagkakamali, isang drastic actions ng superior nya eh, i-frame-up sya, IT staff ang friend ko at sya ang may access sa server room, nasa labas lang ng server room ang cubicle ng friend ko, since for 12 years, wala naman nawawalang gamit sa server room, hindi na daw nilalock ng friend ko ang server room, one time, may nag-iwan ng brand new laptop still in a sealed box, by the why yung superior nya daw, is the one who first to come in of the office and last to come out of the office, to continue, nagreact yung superior nya at tinanong sya bakt daw nasa kanya yung brandnew laptop at nagpaliwanag naman ang friend ko at gumawa din ng incident reports, kaya alam ng friend ko yung superior nya ang naglagay nun para magkaroon sya ng kaso, pero naipaliwanag naman daw ng friend ko ng maayos thru letter na wala syang kinalaman kung baket napunta dun yung laptop. pagkapasa nya ng incident report sa superior nya, wala naman reaction ang superior nya, ang superior nya lang kasi ang mataas na magreview ng incident report at dun din reporting ang friend ko.

1. so it means kahit verbal lang sinabi ng superior nya na baka kasama sya sa redundancy, possible na tumatakbo na ang counting ng days to 30 days,

2. dapat ba may formal letter or written notice na dapat matanggap ang friend ko na matatanggal sya?

dapat may formal letter informing the employees that they will be redundated. upon receipt of the formal letter, then tatakbo na ang 30 days notice.

Atty,

torture yung verbal notice na binigay ng company ng prend ko sa kanya, na kasama syang tatanggalin, kabilang ang 6 na driver,,,,last april, until now wala pang binibigay na written notice, hindi tuloy alam ng prend ko kung ano na gagawin nya, kung maghihintay sya ng notice o tinuturture sya ng boss nya,,, apektado na ang work at pamilya nya,

ano po ba ang dapat nyang gawin, hinintayin ang written notice, hintayin na maframe-up ulit sya ng boss nya? hindi nya alam kung pag-alis nya ng lamesa nya ay may iiwan na gamit sa lamesa o sa area nya na kapag may nawala eh baka sa prend ko daw makita,,, torture psychologically, emotionally ang nangyayari sa verbal warning na yun, hindi pa ibigay yung written notice para makamove-on na daw yung prend ko.

may moral damages ba makukuha prend ko sa torture na ginagawa ng boss nya?

walang moral damages na makukuha. kung ayaw ng “torture” mag resign nalang. kung gusto ng separation pay mag hintay ng written notice

kembot, tell him to write a courteous email/letter and send it to HR. he should ask about the announcement of management and what is his status

kung ililipat po sya sa isang sister company nila, dapat po ba syang bayaran muna bago ilipat sa sister company?

hindi po daw yun inter-department, its a total different firm, company and nature of business but a sister company.

if he demands it, he can be paid separation pay. if he agrees, his seniority can be continued in the new company. if the companies refuse, he can file a complaint at nlrc

good day atty,,,

may pahabol na tanong pa daw po,

1. kung under sya ng redundancy, kailangan pa daw po ba niya magfile ng resignation letter?

2. kung papirmahan daw po sya ng Quit Claims, at hindi sapat yung nakalagay na amount sa quit claims, pede po ba nyang i-hold muna ang pagpirma sa quit claims? para isangguni o i-nego?

3. sa pagbigay ba ng last pay, kasamang i-hold ang salary o yung last pay computation lang para sa redundancy o separation pay? at 1/2 ng 13th month pay?

1. no, pag nag file sya ng resignation hindi na obligado ang employer na bigyan sya ng separation pay.
2. yes but syempre hindi mo nya makukuha yung pera.
3. lahat ng monetary claims kasama i-hold sa last pay.
