1 Father issues on Fri Apr 13, 2018 10:12 am


States po sa article 172 of the family code of the philippines for filiation pf legitimate child is record of birth appearing in civil register at admission in a public document and private hand written instrument signed

Am i obligated to give financial support na dinidemand ng mother na wala po akong pinipirmahan na kahit anong docuements? Are text messages/chat thru messenger can be considered?

Nagbibigay pa din po ako kahit pa konti2. Ngayun kasi wala po akong trabaho at naghahanap pa. Tinatakot na ako ng nanay na kakasuhan

As long as you are the father of the child, you are obliged to give support. It is under our laws.

Kausapin mo kasi ng mabuti yung mother, and state your current financial status. If kelangan ng mediation, go to the nearest barangay hall and request for a barangay conciliation procedure with the officials there. Hopefully, makapag-usap kayo ng maayos kung meron magmemediate sa inyong dalawa.

Sinabi nya sa akin ako yung father pero may lumabas na issue before at nakapagsabi sa akin na hindi daw akin. But i continued to financially support the child even may duda ako. Ayaw nya kasi makinig na wala akong work for 3 months already. Pero nung nag work ako nagbibigay po ako

Punta kayo sa barangay hall and doon kayo mag-usap. Tutulungan kayo ng Barangay officials sa inyong Barangay Conciliation proceedings. Wala pa namang abogado na kailangan kapag sa barangay pa lang ang usapan, so ang focus mo lang nyan is to present your side and come up with a compromise with the mother of the child.

AttyLLL by DNA testing po ba? Cya po ba mag shoulder ng expense na yan? Any other way po ba na ma prove nya ako ang father? Since may pagdududa pa rin po kasi ako because of the text message na natanggap ko before.

you are not legally obligated to guess whether you are the father or not. if you want to take the hard stance, let her get a court order to compel you to a dna test and she has to pay for it

As far as I know, DNA testing to prove someone is the father of the child is not accepted by the courts as jurisprudence dictates.

What DNA testing can do is to prove that someone is NOT the father but it cannot persuasively establish that someone is the father of the child.

Your spouse may use other evidences to prove filiation, like you giving support to the child consistently and other circumstantial evidences. But that is up to her and her lawyer to establish to the courts if there will be litigation.

I hope na sana di na umabot sa litigation kasi malaking gastos para sa inyong dalawa yung pagpunta sa korte. Sana madaan ito sa usapan na lang.

Ano po pwede ko gawin para ma counter yan? Kasi i give support pero not constant para tumahimik cya eh. Sinasabi makukulong ako. Nagsabi pa cya sakin na in a span of 4yrs 2k lng yung binigay ko pero alam ko po nung nag work ako palagi po ako nagpapadala

Your lawyer should devise a strategy to counter such a possibility. Any family lawyer worth his/her salt will know what to do to deny such an allegation.

But you should first undergo Barangay Conciliation before we even entertain the thought of litigation. Litigation is expensive and should be avoided at all costs in order to avoid spending tons of money for that. Kung kaya madala sa mabuting usapan, then that is the best-case result.

If yung situation ayaw nya makinig kasi nag bebase cya sa mga naririnig nya tungkol sa akin. For example sabi nya may trabaho daw talaga ako at d lang ako nagsusustento kahit wala naman po talaga. And If eve magfafile po talaga cya ng case sa akin ng ra9262, she said it will be very easy kasi nga po wala cyang babayaran if magfafile cya. Ano po pwede kong gawin?
