Meron po ako katanungan, yung bahay po namin na sanla ng mama ko sa bank (without our Knowldege) tapus nong nag ka gipitan na sa pera,may Intsik syang kina usap paramag salba sa bahay para hindi ma remati sa banko, nong sinalo na ng Intsik, lumipas ang maraming taon, pina palis na kami s bahay kasi sabi ng intsik hindi na nagbabayad mama ko (which is true) at meron pa tong cash na utang sakanya ang mama ko sa intsik (which is we don't know how much), so what we did umalis at nag rent nlang kami ng bahay. Hindi po nami alam na "nag pirmahan pala sila ng deed of sale daw ng mama ko at intsik" the worst is hindi binayaran pa ang mama ko. parang na isahan yata sya sa instik.


Question:

1. Tama ba Ginawa namin na kusang umalis?
2. Or Meron paba kami chance na makuha ang bahay?
3. meron poba kami laban ng ginawa ng intsik na sya ang buyer sa "deed of sale" na walang binayad na cash kasi daw hindi pa sold ang bahay sa ibang potential buyer

with the deed of sale, it appears that your mother agreed to have her debt condoned in exchange for the house. that is legal

yes actually ganon na nga, pero yung act na nag deed of sale nila, the result is dapat ang intsik na ang may balance na payment sa mama ko kasi ang amount ng bahay is malaki pa kaysa sa utang, so meaning dapat mag tender ng payment ang intsik sa mama ko in respect sa deed of sale na agreed nila. Example Property amount ng bahay namin (3million) menus sa utang w/ interest (500,000) = 2,500,000. so in relation sa deed of sale dapat ba mag tender nang payement si intsik sa mama ko ng 2,500,000 for example? kun hindi sya mag babayad what would be the probable action to be taken?

1. Tama lang naman, pero di nyo kailangan umalis (wala na tayong magagawa, kusa nyo nang ginawa).
2. Kung hindi pa naman napapalipat ng intsik sa pangalan nya yung titulo, ibig sabihin nasa mama mo parin nakapangalan. https://www.alburovillanueva.com/land-titles-real-property-registration Yun lang ang nakikita kong pwedeng maging laban nyo. So i-check mo muna kung kanino nang pangalan nakarehistro yung property.
3. Kahit naman walang binayad na cash, yung condonation ng utang ng mama mo ay maaaring ma-consider as valid consideration sa bentahan.
