Hi Atty,

Hope all is well.

Gusto ko po sana malaman kung may habol po ang mga ahente ko sa possible suspension regarding an overpaid salary. please refer below for the scenario.

May on going na auditing sa Finance Department ng office namin. Just last week (February 28 - March4)na pull out ung 2 ahente ko from operations and kinausap ng HR Associate and Finance Sup.

Sa conversation, they were informed na overpaid sila for 1YEAR na (Supposedly ang sweldo nila ay 11K + 3K, pero ang narereceive daw nila ngaun is ung rate na 12500 + 3K) and kailangan nila bayaran ung 17K sa loob (initially) ng 2months but later on ginawang 4 mos (deduction every cut off).

PInareceive sa kanila ung notice to explain within 24 hours and was informed that there is a possibility na ma-suspend dahil ndi nila ni-report ang over payment nila.

Sa IR ng mga agents, na-mention nila na ung mga points nila like:

1. ndi naman provided ng computation ng salary ang mga employee ng company namin.
2. bakit umabot ng 1 year
3. delayed ang pay slip, minsan isang cut off minsan isang buwan basta inconsistent.
4. sila lng ba ang may kasalanan?
5. babayaran na nga nila, masususpend pa sila. makatarungan ba un?


Now, our HR is claiming na-heads up daw ang mga agent and ako as their supervisor regarding that a long time ago (which is nakalimutan na nga nila agent kung kelan o kung meron mang naging heads-up reagrding sa sweldo) kung meron man we are assuming na pati finance nasabihan din para mabago ung records.

ang pino-point ko sa HR wala naman sa mga agent ung power to change or to make amendments sa salary nila. ngaun kung nag heads up sila sa mga agent malamang nag heads up sila sa Finance. at dahil informed she finance dapat nagkaroon na ng changes sa salary nila and kung ndi nabago kasalanan ng finance na un at ndi ng mga agent. and kung ndi naman na inform ni hr ang finance fault na nila un.

FYI lng po atty, ung mga agents na to ndi nakaugalian na icheck ang mga pay slip nila kasi unang una delayed nga po parati.

just earlier today, i-seserve na nila dapat ung suspension ng mga agents ko kung ndi lng ako ng contest. pero most likely itutuloy pa rin nila ang suspension kung ndi man this week next week.very crucial ang role ng 2 na to sa operations namin and I really need your help.

moderator
i do agree that it would be unfair to suspend the agents, but they do have to pay back the extra amounts credited.

the HR has to be courteously informed that the agents can file a case at nlrc to contest the illegal suspension.

additional question lng po... kasi ndi na nila itinuloy ang suspension. pero may memo pa rin na written warning or verbal warning ang mga agents... o dapat ndi po tlga makatanggap ng kahit anung memo??

i would normally respond to that memo that it is still unwarranted, but if it's too much trouble, they can just let that be.
