I need an advice po.since my client po aq ng divorce via sharia law.almost done na po kmi kc npasok na po sa court ung documents.waiting nalang po kami sa court order,finality at certificate of divorce na maiforward sa registrar.only to find out na kasal po pla c client boy sa another girl b4 ang marriage nya ky client girl.so null po ung marriage nla?anu po ggawin dun?mgpproceed nlang po kami sa process since mlapit na po lumabas ung documents ng divorce?

not sure if there is a sharia law expert here, but under family code, he'd have to file a petition for declaration of nullity

Aq po mismo ang ng aasikaso ng sharia divorce sir...yes tama nga po cguro..ung 2nd wife po ang mgfile ng nullity.pero meron dn option dba?kc sa sharia pwde rn po kc iconvert sa islam ung guy pra mgging valid ung marriage nla ng 2nd at pwde xa idivorce sa sharia.

Salam and Good day,

You have to proceed with the dissolution of 2nd Marriage, which is under Islamic Law sabi mo, kaya nag karoon ng Court Order of Divorce. Since may Court Order na po kayo and waiting for finality, aayosin mo nalang ang annotation ng Marriage Certificate nila.

Sa case po ba ng naunang kasal ito po ay Civil Marriage? Kung Civil Marriage, pwede null and void ang 2nd Marriage but Court lang din ang pwede mag declare ng nullity of Marriage.

Conversion to Islam is not an option for the legality of 2nd Marriage. Remember, kahit mag convert po ang lalaki, kung kasal po ito sa civil, LIABLE pa rin siya for bigamy and all civil liabilities po ay HINDI ma extinguish kahit Muslim na siya. This applies also sa case ng babae na mag convert.  

Dito po sa case na to "...yes tama nga po cguro..ung 2nd wife po ang mgfile ng nullity.pero meron dn option dba?kc sa sharia pwde rn po kc iconvert sa islam ung guy pra mgging valid ung marriage nla ng 2nd at pwde xa idivorce sa sharia." Yes, pwede po ang divorce sa case nila pero given may Court Order of divorce po kayo, Muslim po ang parties, diba?.
