Hi. I was terminated due to AWOL. Makukuha ko parin po ba yung Isang cut off at Tax refund ko ? Kasi sabi po nung mga kasamahan ko kailangan daw po ng clearance din kailangan din po isuli yung mga id's, atm, etc. Ang balak ko po sana is i.sesend ko na lang po thru LBC kasi po umuwe na po ako sa province. Then ang isa ko pa pong question is pwede ko po ba ipakuha na lang sa iba yung back pay ko or pwede po ako mag request na ipadala na lang? kung posible po yung ipakha sa iba gagawa na lang po sana ako ng authorization letter send na alang thru email.

Tanong ko din po na umaabot po ba talaga ng 1yr bago i.realease ang back pay? proven na po kasi yan sa ksamahan namin na nag awol ... 1yr nia po bago nakuha yung back pay niya.

What do you mean back pay. Baka last pay (unpaid work on the cut-off before you were separated, pro rated 13th month pay and tax return).

Even if you are terminated, you still need to process your clearance before receiving your last pay otherwise, they will not give it to you until you do.

If papadala mo lang ang lahat, ano kasiguraduhan mo na receive nila yung pinadala mo? this can be denied, so the best thing is go to your company to process your clearance.

pwede ipakuha ang last pay mo as long as you comply with their requirements. Some company only require authorization letter, some company require SPA.

and yes pwede umabot ng 1 year and more ang release, ang tanong lang diyan kailan ka natapos magpa clearance.

Yun na nga po sir , nasa province na po ako. Gusto ko po maka usap yung nag hahandle sa last pay concern. Ang problema po hindi po nila sinasagot yung mga tawag. Unang beses po ako tumawag may sumagot then na cut po yung line after 5 mins. tumawag po ulit ako hindi na po sinasagot yung phone.
Kaya tinext ko na lang yung number na posible po ba ako maka hinge ng soft copy ng clearance  kasi nang hihinge po ako dun sa mismong branch ko nawala daw po yung files nila kasi nag reset si IT sa back office nila. Pano po nila masasagot yung regarding sa last pay concerns namin kung hindi naman po nila sinasagot yung mga tawag. Even yung mga nakasama ko pa na nag awol, nag resign ganun din yung concern nila na walang sumasagot sa mga tawag nila.

At tska ngayon sir ang ikinaganda lang sa LBC is once na na receive na yung item , may text sila kung sino yung naka receive at kelan na receive. so pag ganun po ba pwede parin nila i.deny na walang nakatanggap nung mga isinauli ko?

Taga Nasipit Agusan Del Norte po ako. Sa MAYBUNGA PASIG po main office ng SOUTHSTAR DRUG.
Ka2uwe ko lang po kasi dito yesterday kasi nag s.study po ako ulit. Dito na po kasi ako sa province nag aaral ulit.Bago po ako umuwe dito tinry ko po kontakin yung main office ... pero bukod po sa hindi sinsagot , pinapatay pa po yung phone. Na DOLE na po sila pero hindi parin po sila nadala... Kakadole pa lang po nag send po ng memo sa bawat store na bawat 1 minute late is 10 pesos po ang kaltas . Tama po ba yun? Pati uniform kaltas sa employee pati training fee kaltas sa employee

Anu pong karapatan nila para ihold yung last pay ng mga employee? Kasi COMPANY RULES? Sa ginawa po ba nila sa mga EMPLOYEE nila sinunod po ba nila yung LABOR CODE?

employers temporary hold the employees last salary so that they can deduct any liabilities the employee have with the company.

In example, if the employee have been assigned a mobile phone and failed to surrender, they will deduct the amount of the mobile phone from the employees last pay, and the remaining balance will be release after checking with other departments if the employee have other liabilities.

so it is better to process your clearance first so that you can get your final pay.
