Tama po bang basta kami sabihan ng landlord namin na ivacate yung house in two months?

just like that sinabihan kami ng landlord namin to vacate the house we are renting.No reason given except gagamitin daw po ng pinsan nya yung house. Bale five-door apartment po ang tinitirhan namin, 10,000.00/ month ang rent. So unang question ko ay bakit kami? Dahil ba kami yung pinaka bagong renter? One year and four months pa lang kami sa apartment. Hindi naman kami behind sa rent, wala naman problem sa pagbabayad namin. minsan nga yung landlord pa and delay kumuha ng rent dahil busy sya. Hindi naman din ganun kadali humanap ng lilipatan dahil sinisigurado rin namin una safe yung lugar, walang problema sa flooding, at hindi gaano malayo sa mga palengke, grocery, at transportation. Pwede ba kaming hindi pumayag na umalis? lalo na at hindi sure na mkakahanap kami ng maayos na lilipatan in two months? Thank you po, sana matulungan nyo kami with good legal advice as always.

if your annual contract has expired, then it's just being renewed month to month. the owner is within his rights. however, if you refuse to leave, he will have to file a case against you to compel you to leave

Thank you po sa reply... May epekto po ba na wala kaming written contract? Hindi naman sa ayaw talaga naming umalis dahil hindi din namin gustong ipagpilitan na tumira...ang gusto lang siguro namin eh maging smooth ang pag alis namin na makahanap lang ng maayos na lilipatan...we have jobs and hindi naman basta mkakapag leave ng matagalan like 2 weeks to focus on looking for a place to relocate. going by what you said, then the 2 months notice the landlord gave us doesn't mean he can throw us out or force us to vacate if ever the 2 months has passed and we still have not found an ideal place, though, there is that hassle of him taking us to court.

The court case may take more than the two months being given to you, but it would be better if you start looking for a place right now. If an ejectment case is filed against you in court, https://www.alburovillanueva.com/ejectment-leased-premises then you will be demanded not only to leave, but also to pay all back rents plus damages (because it is your fault that the owner was deprived of lawful use of his property in whatever way he wants it to be used). Kahit wala kayong written contract, the landlord can look for someone to be a witness who would testify that you are indeed renting only from month to month, so it will not really affect his right to evict you from the premises.
