hello po..

i have a child with an american citizen..we were not married but he signed an acknowledgement of paternity thats why the child bears his family name..the child is 5 years old now..

i have lost communication with the father 5 years ago and do not know even where he is right now..

i am working overseas and got married already...my child is left in the Philippines under the care of my parents but i do go home twice a year..

now, that i want to bring the child for a vacation to the UK, they asked me to produce a court order for sole custody of the child..

Is that necessary? I am the biological mother of the child and is not married to the father? and the child is under 7 years old?

how do i apply for that court order? and what are the requirements? is there no other remedy to this?

can somebody enlighten me about this please...

indeed our laws already state that only the mother of an illegitimate child has custody over the child, regardless of age.

some countries accept an affidavit of sole custody. i cannot speak for what the UK will accept other than a court order. if a petition is required, you may have to make up some story about the father to justify filing the case against him.

Hi,
My wife has a illegitimate 4 yr old daughter and now we all wish to reside in the UAE under my visa.
However the UAE immigration are asking for a NOC from the father. We do not know his where abouts or have any contact details for him.
What can we give them to show that my wife has sole custody and her daughter is free to travel with her from the Philippines?

see if they will accept a copy of art. 176 of our family code, certified by our dfa, where it states the mother shall have sole parental authority over the child; if not you may have to file a petition for custody if only to get an order
