Hi Lawyers,

I'd like to ask if it's legal to put a regular employee on a No Work No Pay Status?

Thank you in advance.

Just to follow up. If it's legal, for how long can an employer put their employees on a No work No pay status?

i clarify ko lang, hindi ka pinapapasok ngayon ng employer? naka floating status ka? dont refer to it as no work no pay status, most people kasi naka no work no pay, for example pag may typhoon, walang sweldo kasi no work.
if ayaw ka papasukin ng employer kasi wala kang gagawin, floating status tawag dun

Yes po.. going on 4 months now na nilagay kami sa no work no pay status. They removed us from the account, until now wala pa din mapaglipatan samin. Though they've tried to endorse us, we've gone through some interview/application but we failed.

Any thoughts on this po.. Thank you.

While it is true that placing an employee on a floating status is valid for a period not exceeding 6 months, THE SAME IS NOT WITHOUT LIMITATION. "For a floating status to be valid, the law requires that the same be occasioned on the DIRE EXIGENCY OF THE EMPLOYER'S BONA FIDE SUSPENSION OF OPERATION, BUSINESS OR UNDERTAKING." Thus, for reason other than this, placing an employee under floating status is unlawful.

Instead, they held us liable for Gross Neglect.

Regarding your case, I've seen that the employer did try something in their end:

Don't get me wrong po.. Bali I'm just asking lang po for your thoughts or opinion dun sa argument na yun. Kasi parang it contradict yung paglalagay ng employer sa no work no pay kay employees.

Yes they did their part po. Pero what happened during interviews was more of interrogation about sa kinaso samin. Kumbaga, walang proper endorsement.

yes then why are you using an article from the labor code regarding floating status?

again everyone unless specified otherwise is on a no work no pay status. legal sya kasi lahat ng empleyado ay naka no work no pay status unless nakasulat sa contract nya na may sahod parin sya kahit hindi sya pumasok

Dumaan din kasi kami sa floating status then pinapirma na kami ng no work no pay afterwards. Dahil alam ko na you know better.

Thank you anyway.

First, they gave us an indefinite suspension, 30 days. Then na reinstate kami, binayaran nila yung suspension. Next is nalagay kami sa floating status, yung mag llogin logout ka lang with pay.

Now no work no pay na kami, nag start ng May 2018, going on 4 months na..

You said 30 days... then that is not indefinite. If not, after 6 months, entitled kayo sa separation pay.

Sorry, my bad.

Gaya ng nabanggit ko, kung may pa interview man sila ay more on interrogation yung nangyayari, hindi kami natatanggap, mas preferred pa ng hiring manager ang external. Dahil siguro sa kinaso samin. Parang constructive dismissal na nga po eh..
