Hello po.

Ask ko lang yong case ko. Hired po ako as Project Based employee then yearly nirerenew ung contract ko same position (office clerk). Yong work ko po regular hindi by project. Ngayon po may DOLE order sa company namin na iregular lahat ng Project Based employee na hindi naman hired by project, yong admin po namin namili lang ng mga ireregular ako hindi kasama, reason po nila pinili lang nila yong mga mas kailangan ng company eh ako may recommendation ng boss ko nakailangan nya ako as his secretary pero hindi pinapakinggan ng admin namin ung boss ko ang sabi sa sunod nalang daw ako. Dapat po ba kasama ako sa mareregular? 2 years na po akong casual sa company na pinapasukan ko.

moderator
considering there was no real project, you are already are a regular employee and entitled to security of tenure. if the company refuses, your legal recourse is to go to dole and file a complaint

Ako po ay isang empleyado ng MG EXEO which is sub contractor po ni PLDT.
Contract ko po
"Your employment with the COMPANY shall be co-terminus with the project and manpower needs and requirement of the department, phase or section where you are assigned, or the completion of the or termination of the project, whichever comes first. In the event that the projects or any phase thereof where you are assigbed is extended beyond the aforesaid period, your project employment shall be correspondingly extended and shall terminate upon the completion of the said extended phase of the project. The aforesaid project is estimated to completed on APRIL 30, 2020. Nothing contained in the agreement shall be construed or interpreted as establishing regularity of your employment with the COMPANY, regardless of the duration or length of time your PROJECT-BASED EMPLOYMENT as provided above."

Ganto po kase nangyari. Pinatigil po ng dole ang company namin na mag operate at makalipas ang ilang buwan e mag ooperate na sila pero sa ibang kumpanya na hind na po PLDT.
Ang tanong ko lang po. Dapat bang bayaran kami ng kumpanya namin dun sa unang kontrata bago sila mag operate ulit para sa ibang kumpanya na?
May habol ba kami dun sa dating kontrata?

nilipat ka ba ng "kumpanya"? meaning dati serving from pldt to serving to the new company?

ano ang hinahanap mong bayaran?

usually ang service provider ay pwede silang mag bigay ng serbisyo sa iba't ibang kumpanya. pag nawala yung isang client nila (pldt), terminated na din ang project contract mo. pwede ka naman nila i hire para sa ibang project (new company).

1.PLACE OF UNDERTAKING: You shall be specifically assigned at the Cable Department(Batangas/Laguna) as Repairman 5 for the PLDT NCSLP 2017 Project.

2. Yan pong nakapost.

Kase sir ang pinirmahan kong kontrata ay para sa PLDT project lang kaya ko po natanong. Kase baka ilipat kami ng kumpanya at ibang lugar. Pano po kaya yun?

May matatanggap po ba kami since nag end project sya. Kase di naman PLDT ang nagpa End of Contract e kundi dahil po sa pagiging labor only contracting sila sabi ng dole.

ang problema since dole ang nag utos na itigil nila ang contract. force majure yan at wala nang pananagutan c mg exeo para sa unang contract.
your options are:
1. mag try ka mag pa regular sa pldt citing dole ruling re mg exeo.
2. dumulog sa dole na natanngal ka sa trabaho dahil sa ruling nila. (ask them who will compensate you for the cancelled contract)

both options Malabo but i guess nothing to lose ka naman. kasalanan ng dole yan, hindi naman nag labor only contracting ang mg exeo, they are legitimate contractors who install telecom equipment.
