good day po...may nahiram po akong money sa friend ko almost 4months di ko po nababayaran na buo.pero if tnetxt nya ako na pag ipunan yung hulog ko nagrereply naman ako.kasi may matinding problem po kasi dumating sa amin.alam po nya lahat yun.to make the long story short.idedemanda daw po ako for stapa.kasi dapat po kanina mag uusapa kami dun sa office ng lawyer nya.nagpunta po ako 8am kasi 8am ang usapan.dumating ako sa office nya wala daw nasa bahay pa.tnawagan ko di cnasagot.dinarop po yung tawag ko.then nung nasa house na ako nagtxt yung lawyer."ayaw po n madammakipag usap n..kaya po d tuloy ung 8am natin.gusto na lang daw magkaso.sori"so pano po kaya ang gagawin ko.nagtxt ako dun sa lawyer and ang sabi ko "gusto ko naman po makipag usapa at di ko tatakbuhan. willing akong magbayad pero wala po akong pambayad ng buo, kaya nga po nakikiusap ako na bayaran ko ng hulog hulugan" wala n reply c lawyer....

failure to pay a debt is not estafa, unless they have proof that you committed abuse of confidence or deceit to get the money. but if it's just a loan, then that's not a crime.

offer as big a downpayment you can and installments. there's nothing else much you can do.

so ano po sasabihin ko dun sa lawyer nya????kasi yung mismong taong nagpautang ang ayaw makipag usap sa akin sabi nung lawyer nya gusto daw kaso na agad.pano ko naman po madedefend yung sarili ko???nakiusap ako na wala po akong pambayad nang bou na iniinsist po kasi nila.

atty,wat if ayw nung tao na magbayad ako ng installment?at ang gusto buo?kung wla akong ibabayad eh kakasuhan na lang ako.pero willing naman po akong magbayad yung nga lang po hulugan aksi talagang down ako ngaun.ano po ba pwede nyang isampa sa aking kaso???

you cannot prevent them from filing a case against you if they do not accept your offer.

i recommend you make an offer, as big a downpayment you can then the rest monthly. don't sign anything unless you agree to its contents.

Hi atty.pwede po bang padalahan ako ng demand letter kung nakakausap and nagkikita naman po kami nung taong nahiraman ko?nag offer na po ako na magbbigay kahit pano pero ayaw nya pong tanggapin ang gusto nya buo daw po.cnabi ko naman po sa kanya na wala akong pambayad ng buo kasi nga po wala yung mga business namin laht po sarado na.kaya nakikiusap po ako na kung pwede sana eh hulugan ko na lang muna.pero ayaw po nya.di po cya sumasagot sa txt ko.

you can't prevent them from sending you a demand letter or filing a collection case against you. i suggest you keep talking to them.
