Hi po. Good day. Newbie lang po ako dito. I-cconsult ko lang po yung current situation ko. Bumili po kame ng bahay dito sa novaliches and almost 80% na po ang naibayad namin. Ngayon po ay nagbabayad kame ng monthly mortgage kaso po ay mag-tatatlong buwan na po akong di nakakabayad. Nakareceive na po ako ng notice galing sa developer na makakasuhan po ako ng estafa since tumalbog ung inissue ko po na post dated checks. Meron po kami na isa pang property na binebenta pero inaayos pa ang title kaya di pa maibenta-benta kaya di ko mabayaran ng buo ang kulang ko para sa bahay na kinuha namin. Hindi ko po inaasahan na ganito ang mangyayari kaya po ngayon ay nammroblema ako dahil ayoko po na makasuhan ng estafa. Ano po kaya ang dapat kong gawin sa puntong ito. Ayoko din naman po na mauwi sa foreclosure ang property na halos nabayaran ko na ng buo. Sana po ay matulungan nyo po ako. Maraming salamat po.

Im not a lawyer pero nangyari na din sa akin yan...try to talk to the developer or financial institution to restructure your loan....kung hindi pumayag, mamimili lang ang developer ng kung violation of BP 22 or foreclosure. kung ung una, may imprisonment ka, kung ung foreclosure meron ka pa naman one year to redeem your property or kung pasok ito sa Maceda Law merong percentage na ibinayad sayo na pwedeng mabalik sa iyo..assuming di mapakiusapan 'yan ang mga options mo hope you fall to a lesser evil....with all due respect to our lawyer moderators...just sharing personal experience...

any case of estafa should not prosper; but a case of bp 22 has a good chance.

is the title of the property already in your name. if not, then i believe what you had was a contract to sell. there is no mortgage because the property is still in the name of the developer.
